SECTION. 2. And be it further enacted, That the collector of the 1836. port of New York, is hereby authorized and directed to extend Time extended on the payments in the manner prescribed in the first section of this act, of all other bonds given for duties at the port of New York prior to the late fire, and not provided for in the first section as aforesaid, for six, nine, and twelve months, from and after the date of payment specified in the bonds; which bonds when executed agreeably to the provisions of this section, shall be payable with interest, at the rate of five per centum per annum, which interest, shall be computed from the times the respective bonds would have fallen due, if this act had not passed; Pro- Proviso. vided however, That nothing contained in this act, shall extend to bonds which had fallen due before the 17th day of December last: Provided also, That if in the opinion of the collector Proviso. aforesaid, any of the bonds which may be given under this act or the payment of which may be postponed, shall at any time be insecure, it shall be the duty of the said collector to require such additional security as shall be satisfactory to him, and on the failure of such additional security being furnished, the payment of such bond shall be enforced forthwith.

CHAP. 43. An ACT authorizing the Secretary of War to transfer a part of the appropriation for the suppression of Indian hostilities in Florida, to the credit of subsistence.

[SEC. 1.] Be it enacted by the Senate and House of Represenlatives of the United States of America in Congress assembled, That the Secretary of War is hereby authorized to transfer so much of the appropriation for the suppression of Indian hostilities in Florida, to the credit of subsistence, as may have been taken from the latter fund, for the former purpose.

CHAP. 44. An ACT to provide for the payment of volunteers and militia corps, in the service of the United States.

SECTION 2. And be it further enacted, That the officers of all Officers of mount mounted companies who have been in, or may hereafter be in, est companies, al- the service of the United States, shall each be entitled to receive forage, or money in lieu thereof, for two horses, when they actually keep private servants, and for one horse when without private servants and that forty cents per day be allowed for the use and risk of each horse, except horses killed in battle or dying of wounds received in battle. That each non-commissioned officer, musician, artificer and private, of all mounted companies, shall be entitled to recive forage in kind for one horse, with forty cents per day for the use and risk thereof, except horses killed in battle, or dying of wounds received in battle, and twenty-five cents per day in lieu of forage and subsistence, when the same shall be furnished by himself, or twelve and a half cents per day for either as the case may be.

SECTION 3. And be it further enacted, That the officers, noncommissioned officers, musicians, artificers and privates, shall be entitled to one day's pay, subsistence, and other allowances, for every twenty miles' travel from their places of residence to the place of general rendezvous, and from the place of discharge back to their residence.

SECTION 4. And be it further enacted, That the volunteers or wounded or disa militia, who have been or who may be received into the service of the United States, to suppress Indian depredations in Florida, shall be entitled to all the benefits which are conferred on persons wounded or otherwise disabled in the service of the United States.

SECTION 5. And be it further enacted, That when any officer, non-commissioned officer, artificer, or private, of said militia or volunteer corps, who shall die in the service of the United States, or returning to his place of residence after being mustered out of service or at any time in consequence of wounds received in service, and shall leave a widow, or if no widow, a child or children under sixteen years of age, such widow, or if no widow, such child or children, shall be entitled to receive half the monthly pay to which the deceased was entitled, at the time of his death, for and during the term of five years; and in case of the death or intermarriage of such widow before the expiration of five years, the half pay for the remainder of the tinie shall go to the child or children of said decedent: Provided always, That the Secretary of War shall adopt such forms of evidence, in applications under this act, as the President of the United States may prescribe.

SECTION 6. And be it further enacted, That the volunteers and and militia are in militia mentioned in the foregoing provisions of this act, called into service before its passage, and who are directed to be paid, shall embrace those only ordered into service by the commanding general or Governors of States and of the Territory of Florida under authority from the War Department for repressing the hostilities of the Florida Indians.

CHAP. 45. An ACT to authorize the conveyance of certain lands belonging 1836. to the University of Michigan.

[SEC. 1.] Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the trustees of the University of Michigan, be and Trustees they are hereby authorized, to convey to William Oliver, by a deed signed by the president, and countersigned by the secretary of said board of trustees, the following tracts of land, lying near Toledo, on the Miami of the Lake, to wit, tracts numbered three and four, and the southwest quarter of section number two, and the west half of section number three, in township number three, within the twelve mile reservation at the foot of the rapids of the said Miami river, pursuant to a contract entered into between the said trustees, and the said William Oliver, on the twentyfourth and twenty-fifth days of October, anno Domini, eighteen hundred and thirty-four.

SEC. 2. And be it further enacted, That the act entitled An Act of March 30, act to authorize the sale of certain lands belonged to the Uni-135, repealed versity of Michigan, approved March third, eighteen hundred and thirty-five, be, and the same is hereby, repealed; Provided Proviso. that the product arising from the sale of said land, shall be considered, and shall constitute a part of the general funds appropriated for the University of Michigan.

CHAP. 46. An ACT making a further appropriation for the suppression of
Indian hostilities in Florida.

[SEC. 1.] Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the sum of five hundred thousand dollars be, and the same $500,000. is hereby appropriated, out of any money in the Treasury not otherwise appropriated, in addition to former appropriations, for suppressing Indian hostilities in Florida.

CHAP. 47. An ACT amendatory of "the act for the relief of the sufferers by fire in the city of New York," passed March 19th, 1836.

[SEC. 1.] Be it enacted by the Senate and House of Represenlatives of the United States of America in Congress assembled, That the operation of the act entitled "An act for the relief of Act of March 19 the sufferers by fire in the city of New York passed the nineteenth day of March last past, shall be, and hereby is limited and confined exclusively to such bonds of the description set forth in said act, as were made and entered into at the customhouse in the city of New York prior to the sixteenth day of December last past. Approved April 5th, 1836.

1836. CHAP. 48. An ACT to suspend the operation of the second proviso, third section of "An act making appropriations for the civil and diplomatic expenses of Government for the year one thousand eight hundred and thirty-five.

[SEC. 1.] Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That so much of the third section of the act, entitled "An act making appropriations for the civil and diplomatic expenses of Government for the year 1835," as provides "that the whole number of custom-house officers in the United States, on the 1st of January, 1834, shall not be increased until otherwise allowed by Congress," be, and the same is hereby suspended to the end of the present session of Congress.

CHAP. 49. An ACT for the relief of Henry B. Tyler, executor of Colonelˇ
Richard Smith, deceased.

[SEC. 1.] Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, 82556 64 to be That the proper accounting officers of the Treasury be, and they are hereby, authorized and directed to pass to the credit of Henry B. Tyler, executor of the last will and testament of Lieutenant Colonel Richard Smith, deceased, the sum of two thousand five hundred and fifty-eight dollars and sixty-four cents, being the balance remaining unpaid to said Smith of the moneys accruing to him under the provisions of an act of Congress approved on the 14th day of July, one thousand eight hundred and thirtytwo, entitled An act concerning officers of the marine corps," and to pay the same out of any money in the Treasury not otherwise appropriated. Approved April 9th, 1836.

CHAP. 50. An ACT to repeal so much of the act entitled "An act transferring the duties of Commissioner of Loans to the Bank of the United States, and abolishing the office of Commissioner of Loans," as requires the Bank of the United States to perform the duties of Commissioner of Loans for the several States.

[SEC. 1.] Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the first second and third sections of the act entitled "An act transferring the duties of Commissioner of Loans to the Bank of the United States, and abolishing the office of Commissioner of Loans," passed March third, eighteen hundred and seventeen, be, and the same are hereby repealed; and the Bank of the United States and its several branches, and such State Banks employed under the provisions of said act by the Bank of the United States, as have heretofore done and performed, or are now doing and performing, the duties of Commissioner of Loans, shall be, and they are hereby, required to transmit to the Secretary of the Treasury, immediately after the passing of this act,.

SECTION 2. SECTION 3. And be it further enacted, That it shall be the duty of the Secretary of the Treasury to pay over to the person or persons entitled to receive the same, the amount so received into the Treasury by virtue of the second section of this act, out of any money in the Treasury not otherwise appropriated.

SECTION 4. And be it further enacted, That nothing contained in this act shall be construed to authorize the appointment of a Commissioner or Commissioners of Loans in any State, District, or Territory of the United States.

CHAP. 51. An ACT to extend the time for selling the land granted to the incorporated Kentucky asylum, for teaching the deaf and dumb.

[SEC 1.] Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the further time of two years, from and after the fifth day Time of April, one thousand eight hundred and thirty-six, be and the 5th of April, 1836. same is hereby allowed the trustees of the Centre college of Kentucky, who are also trustees of the Kentucky asylum for teaching the deaf and dumb, to sell the land granted to said trustees for the use and benefit of said asylum, by an act entitled "An act for the benefit of the incorporated Kentucky asylum for teaching the deaf and dumb," approved the fifth day of April, one thousand eight hundred and twenty-six.

CHAP. 52. An ACT making appropriations for the payment of the revolu tionary and other pensioners of the United States, for the year one thousand eight hundred and thirty-six.

[SEC. 1.] Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the following sums be, and the same are hereby appropri ated to be paid out of any money in the Treasury, not otherwise appropriated, for the pensioners of the United States, for the year one thousand eight hundred and thirty-six;
