[CHAP. 69. An ACT for the relief of Israel Ingalls.

[SEC. 1.] Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, from March 4th That the Secretary of War be, and he is hereby, required to place the name of Israel Ingalls, of Hamilton county, Ohio, on the roll of revolutionary pensioners; and to pay him a pension, at the rate of twenty dollars per annum, to commence, and be computed, from the fourth day of March, one thousand eight hundred and thirty-one. CHAP. 70. An ACT for the relief of Amy Wilson.

[SEC. 1.] Be it enacted by the Senate and House of Represen#89 43 to be paid tatives of the United States of America in Congress assembled, That the Secretary of War pay to Amy Wilson, widow of Valentine Wilson, the sum of eighty-nine dollars and forty-three cents, being the amount due on a pension certificate given in favor of the said Valentine Wilson at the War Office of the United States, on the eighth day of March, one thousand eight hundred and thirty-four, and subsequently to his death, which took place on the fourth day of July, eighteen hundred and thirty-three.

CHAP. 71. An ACT granting a pension to Colonel Gideon Morgan, of the
State of Tennessee.

[SEC. 1.] Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, $30 per month That the Secretary of War be, and he is hereby, directed to place the name of Colonel Gideon Morgan, of the State of Tennessee, on the roll of invalid pensioners, at the rate of thirty dollars per month, to commence on the first day of January, in the year eighteen hundred and thirty-four and to continue during his natural life. Approved, May 14th, 1836.

CHAP. 72. An ACT for the relief of Elizabeth Mays, mother of Wilson Mays, deceased, in the naval service of the United States.

CHAP. 73. An ACT for the relief of Joseph W. Wormstead, of Marblehead, master and owner of the schooner Sally, and the crew of said vessel. [SEC. 1.] Be it enacted by the Senate and House of Represen tatives of the United States of America in Congress assembled, That the collector of the port of Marblehead, in the State of Collector at MarMassachusetts be, and he is hereby, authorized to pay to Joseph bounty. W. Wormstead and the crew of the schooner Sally, which was lost at sea, to be distributed according to law, the same allowance or bounty as they would have been entitled to receive if the said vessel had arrived in port after having completed her fishing term, and complied with all the requirements of law necessary to secure such bounty. CHAP. 74. An ACT for the relief of Peter Doxtator and Jacob Weaver.

[SEC. 1.] Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Secretary of War be authorized and required to place $30 per annuin to the names of Peter Doxtator and Jacob Weaver, on the list of March, 1831. revolutionary pensioners, and pay to each of them the sum of eighty dollars, per annum, commencing on the fourth day of March, eighteen hundred and thirty-one, and to continue during their natural lives. Approved, May 14th, 1836.

CHAP. 75. An ACT for the relief of Melancthon Taylor Woolsey. [SEC. 1.] Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That there be retained from the pay of Melancthon Taylor One-third of the Woolsey, a captain in the navy of the United States, one third to be retained. part of the amount thereof, and no more, from the time of the passage of the act of March third, eighteen hundred and thirtyfive, regulating the pay of the navy, until the amount of arrears due from said Woolsey to the United States shall be discharged; any act or part of an act to the contrary notwithstanding.

CHAP. 76. An ACT to give effect to patents for public lands issued in the names of deceased persons.

[SEC. 1.] Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That in all cases where patents for public lands have been or may hereafter be issued, in pursuance of any law of the United States, to a person who had died, or who shall hereafter die, before the date of such patent, the title to the land designated therein shall enure to, and become vested in, the heirs, devisees. or assignees of such deceased patentee, as if the patent had issued to the deceased person during life; and the provisions of this act shall be construed to extend to patents for lands within the Virginia Military District in the State of Ohio.

CHAP. 77. An ACT explanatory of the act entitled "An act to prevent defalcations on the part of the disbursing agents of the Government, and for other purposes."

[SEC. 1.] Be it enacted, by the Senate and House of Represen tatives of the United States of America in Congress assembled, Act of Jan. 1928, That, the act entitled "An act to prevent defalcations on the part of the disbursing agents of the Government, and for other purposes," approved the twenty-fifth of January, eighteen hundred and twenty-eight, shall not be construed to authorize the pension of any pensioner of the United States to be withheld. Approved, May 20th, 1836.

CHAP. 78. An ACT for the relief of the representative of Robert Jouet, deceased.

[SEC. 1.] Be it enacted, by the Senate and House of Represen tatives of the United States of America in Congress assembled, Five years' full That the proper accounting officers of the Treasury do settle the pay of Lieut. of Infantry. claim of James W. Boulden, representative of Robert Jouet, deceased, a lieutenant of the Virginia line, on continental establishlishment, in the revolutionary army, and to allow him five years' full pay of a lieutenant of infantry of the said line.

CHAP. 79. An ACT for the relief of the several corporate cities of the District of Columbia.

[SEC. 1.] Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, Debt contracted That the Secretary of the Treasury be, and he is hereby, aumed by the U. S. thorized and directed to assume, on behalf of the United States, and discharge, to the holders of the evidences of debt contracted and entered into between the cities of Washington, Alexandria, and Georgetown, and certain individuals in Holland, negotiated by Richard Rush, Esquire, on behalf of said corporate bodies, the entire obligation of paying said debts, with the accruing interest thereon, together with the interest now due and remaining unpaid, according to the terms of said contract.

SECTION 2. And be it further enacted, That before the said Secretary of the Treasury, shall execute the duties prescribed by the first section of this act, the said corporate authorities of said cities shall deposite in the hands of the said Secretary of the Treasury, the stock in the said Chesapeake and Ohio Canal Company, held by them respectively; and the said Secretary of the 'Treasury may, at such time within ten years, as may be most favorable for the sale of said stock, dispose thereof at public sale, and reimburse to the United States such sums as may have been paid under the provisions of this act; and if any surplus remain after said reimbursement, he shall pay over said surplus to said cities, in proportion to the amount of stock now held by them respectively. CHAP. 80. An ACT authorizing the President of the United States to accept the service of volunteers, and to raise an additional regiment of dragoons or mounted riflemen.

[SEC. 1.] Be it enacted by the Senate and House of Representatives of the United States of America in Congress assem

bled, That the President of the United States be, and he hereby President may acis authorized to accept volunteers who may offer their services of 10,000 voluneither as infantry or cavalry not exceeding ten thousand men, teers, &c. to serve six or twelve months after they shall have arrived at the place of rendezvous, unless sooner discharged; and the said volunteers shall furnish their own clothes, and, if cavalry, their own horses, and when mustered into service, shall be armed and equipped at the expense of the United States.

SEC. 2. And be it further enacted, That the said volunteers To do military shall be liable to be called upon to do military duty only in cases of Indian hostilities, or to repel invasions, whenever the President shall judge proper, and when called into actual service and while remaining therein, shall be subject to the rules and articles of war, and shall be in all respects, except as to clothing, placed on the same footing with similar corps of the United States army and in lieu of clothing every non-commissioned officer and private, in any company, who may thus offer themselves, shall be entitled, when called into actual service, to receive in money a sum equal to the cost of the clothing of a non-commisson ed officer or private (as the case may be) in the regular troops of the United States.

SEC. 3. And be it further enacted, That the said volunteers, To be received in so offering their services, shall be accepted by the President in companies, battalions, squadrons. regiments, brigades, or divisions, whose officers shall be appointed in the manner prescribed by law. in the several States and Territories, to which such companies, battalions, squadrons, regiments, brigades, or divisions, shall respectively belong. SEC. 4. SEC 5. And be it further enacted, That the volunteers who may be received into the service of the United States, by virtue of the provisions of this act, shall be entitled to all the benefits which may be conferred on persons wounded in the service of the United States.

SEC. 6. And be it further enacted, That there shall be go to be orga- raised and organized, under the direction of the President of the United States, one additional regiment of dragoons or mounted riflemen, to be composed of the same number and rank of the officers, non-commissioned officers, musicians and privates, composing the regiment of dragoons now in the service of the United States, who shall receive the same pay and allowances, be subject to the same rules and regulations, and be engaged for the like term, and upon the same conditions, in all respects whatever as are stipulated for the said regiment of dragoons now in

SEC. 7. And be it further enacted, That the President of the United States may disband the said regiment, whenever in his opinion, the public interest no longer requires their services; and that the sum of three hundred thousand dollars, required to carry into effect the provisions of this act is hereby appropriated, out of any money in the Treasury not otherwise appropriated.

SEC. 8. And be it further enacted, That so much of this act as relates to volunteers shall be in force for two years from and after the passage of this act, and no longer.

CHAP. 81. An ACT making appropriation for the suppression of hostilities by the Creek Indians.

[SEC. 1.] Be it enacted by the Senate and House of Represen tatives of the United States of America in Congress assembled That the sum of five hundred thousand dollars, be, and the same is hereby appropriated, out of any money in the Treasury not otherwise appropriated, to defray any expenses which have been or may be incurred in suppressing hostilities by the Creek In dians, by calling out, by the President, of any part of the militi of the United States, according to the provisions of the consti tution and law; which sum, if expended shall be expended unde the direction of the Secretary of War, conformably to the provi sions of the act of Congress, of second of January, seventee hundred and ninety-five; of the act of fifth of April, eightee hundred and thirty-two, making appropriations for the suppor of the army; and of the act of the nineteenth March, eightee hundred and thirty-six, providing for the payment of volunteer and militia corps in the service of the United States. Approved, May 23d, 1836.
