The Council met.

PHILADELPHIA, Wednesday, April 26th, 1786.

PRESENT:

The Honorable CHARLES BIDDLE, Esquire, Vice President.

Captain Stiles, Commissary of military stores, was directed to deliver to Colonel Joseph Marsh eighty-two empty cannon catridges; and to Colonels William Will, Benjamin G. Eyre and Matthew Holegate, two hundred weight of gunpowder, in the following proportions, vizt: to Colonel William Will seventy-five weight, to Colonel Benjamin G. Eyre seventy-five weight, and to Colonel Matthew Holegate fifty weight, for the use of the militia under their command, at their next meeting.

An order was drawn upon the Treasurer in favor of the Commissioners for running and marking the Northern boundary of this State, for one hundred and fifty pounds specie, to enable them to enter upon the business of their appointment, for which sum they

are to account.

The Council met.

PHILADELPHIA, Friday, April 28th, 1786.

The following orders were drawn upon the Treasurer, vizt:

In favor of the Honorable John Whitehill, Esquire, for fifty pounds ten shillings, in full for his attendance in Council until this day, inclusively, and his mileage.

In favor of Colonel William Coats, for thirty pounds fifteen shillings, for defraying the contingent expences of exercising the militia of the county of Philadelphia, for which sum he is to account, to be paid out of the militia fines of the said county.

In favor of James McCutcheon, for the sum of fifty-three pounds. ten shillings and six pence, in full of his account for beef furnished to a number of East Indians, under a resolution of Assembly dated the seventh day of November, 1785.

In favor of Messieurs James Smith, Francis Silvers and John Boggs, Commissioners for laying out a road from Miller's Spring, in Cumberland county, to Pittsburg, for the sum of one hundred pounds, towards defraying the expence of laying out the said road, according to act of Assembly dated the twenty-first day of September, 1785, for which they are to account.

In favor of Francis Bailey, for one hundred and two pounds nineteen shillings and sixpence, in full of his account for printing work done for Council, until this day, according to the Comptroller General's report.

Upon the petition of Catherine Miller and Elizabeth Ohara. convicted of larceny at the present sessions of the City Court, and recommendations in their favor from the said court, it was

Ordered, That the fines and corporal punishment to which they were respectively sentenced, be remitted.

The fine and punishment of John Smith Lestor, convicted of the same offence, at the said court, was, in consideration of the particular circumstances of the case, remitted.

Two deeds were signed by the Hon'ble the Vice President, vizt:

To Anthony Cuthbert, for city lots number 1700 and 1701; Consid'n £327 0 0; and to Mr. Joseph Carson, for city lots numbered from 1592 to 1532, inclusively: Consideration £173 0 0. Sold for the redemption of the bills of credit dated the 29th day of April, 1780. Deeds dated 26th April, 1786.

The fines adjudged to be paid to the use of the State by Philip. Huffnagle, Arthur McGaraty, Christian Peters and Peter Rooney, now confined in the jail of the city and county of Philadelphia, were remitted.

An order was taken that Colonel Josiah Harmer be desired to pay to Captain McCurdy thirty-six dollars, being money advanced by him in inlisting twelve recruits, that were inrolled in Captain Ziegler's company.

Ordered, That the Secretary write to Mr. Rittenhouse, desiring him to settle with Mr. John Dunlap for the city lots that have fallen to his share, under an agreement between him and Mr. James Budden.

The Council met.

PHILADELPHIA, Saturday, April 29th, 1786.

Everard Gruber, Esquire, was appointed and commissionated a Justice of the Peace for the district of the townships of Strasburg and Lampeter, in the county of Lancaster, and also a Justice of the Court of Common Pleas in and for the county aforesaid.

An order was drawn upon the Treasurer in favor of the Honorable Peter Muhlenberg, Esquire, for the sum of twentytwo pounds ten shillings, in full for his attendance in Council until the thirtieth instant, inclusively.

A petition from the Minister of the Lutheran church in the city of Albany, praying liberty to collect monies from the pious and benevolent in this State, for the purpose of building a house for public worship, was read; and thereupon

Reolved, That the said Minister be informed that Council have no objection to his setting on foot a subscription for the purpose mentioned in the petition.

Council proceeded to the election of an Inspector of the militia of this State; and the ballots being taken, it appeared that Francis Mentges, Esquire, was unanimously elected.

A petition signed by five hundred and forty-eight inhabitants of the county of Dauphine, praying that Council would be pleased to suspend the infliction of any fines or penalties on the Commissioners of the said county, for having declined to assess and levy monies on the inhabitants, for the purpose of building a court-house and prison, at a place so inconvenient as Harris's Ferry, until the event of the remonstrance and petition now before the General Assembly, praying that the seat of justice be appointed at a more convenient part of the county, is determined by the Legislature, was read, and the prayer thereof granted.

A deed was signed by the Vice President for fourteen acres and thirty-four perches of land, situate in Tinicum township, in the county of Bucks, late of Evan Thomas, an attainted traytor, sold to George Benner, at public auction. Deed dated this day.

Captain Joseph Stiles was directed to deliver to Colonel John Shee, or order, the sum of fifty weight of gunpowder, for the use of the militia of his battalion, at their next meeting.

Friday next, the fifth instant, was assigned for going into the appointment of a Prothonotary, Clerk of General Quarter Sessions of the Peace and Orphans' Court, &ca., for the county of York, become vacant by the death of Archibald M'Clean, Esquire.

Mr. Balliet attended the Vice President as a member of the Board of Property.

The Auctioneer of the city of Philadelphia was directed to proceed to the sale of the house and lot of ground, sixty feet front on the south side of Market street, and one hundred and eighty feet

in depth on the east side of Sixth street from Delaware, clear of all incumbrances whatever, save only forty-four dollars per annum, payable to William Attmore, or his assigus, from the first day of December last.

An order was taken that Captain Joseph Stiles be directed to furnish one horsemau's tent, for the use of the Commissioners appointed to run and mark the northern boundary of Pennsylvania, they to be accountable.

The following orders were drawn upon the Treasurer, vizt:

In favor of Mr. Stephen Porter, for one hundred and fifty-three pounds three shillings and five pence, in full of his account for sundry expences attending the running and marking the Western boundary of this State.

In favor of Frederick Sneider, for fifteen pounds seven shillings and six pence, in full for his wages as Door-keeper, for the month of April, and cash paid for a new key for the Council door.

Upon the petition of Bridget Edgsworth, convicted of larceny at the Sessions of the City Court, held in April last, it was

Ordered, That the fine adjudged to be paid to the use of the State by the said Bridget Edgsworth, and her corporal punishment,

be remitted.

The fiue imposed upon Joseph Hibbs, payable to the use of the State, upon conviction of larceny at the same Court, was remitted.

A memorial from sundry officers of the late Pennsylvania line, stating that large bodies of excellent land remain yet unsurveyed on the waters of Beaver river, in the donation land, very far superior in value, quality, and situation, to the lands in district number nine, and praying that the number of lots designed for the ninth district
