That the owner or owners of any such vessel, or their agent or agents, and the commanders or masters of such vessel, found guilty after indictment in any district or circuit court of the United States of a violation of this act, shall be fined in a sum not less than $1,000 nor more than $5,000, and may, at the discretion of the court, be imprisoned in the penitentiary for a term not exceeding two years."
