Edward Cook, Lieutenant of the county of Westmoreland, were read and approved. Upon the petitions of Charles Biddle, Adam Gilchrist, James Dunlap, Benjamin Bradhurst, Thomas Clarke, Isaac Van Vleck, Robert Smith, and William Barton, passports were granted to each to go into New York, by the way of Dobbs' Ferry, and to return. The Council met. PHILADELPHIA, Wednesday, April 2nd, 1783. PRESENT: His Excellency JOHN DICKINSON, Esquire, President. The Honorable JAMES EWING, Esquire, Vice President. The Honorable James Irvine, James Potter, James Cunningham, Christopher Hayes, The Comptrollers-General's report upon the account of the Honorable John Montgomery. Esquire, for his attendance in Congress, was read, and an order drawn upon the Treasurer for the sum of forty-eight pounds, being the amount of the said account for attendance as aforesaid, till this day. An order was drawn on the Treasurer in favor of Messieurs Samuel Hodgson and Alexander Boyd, for the sum of fifty-one pounds nineteen shillings and eight pence specie, being the amount of their account for the pay of Mr. Boyd, and horse hire and expences of him and Mr. Hodgson on their journey to Chester, for the purpose of inspecting British goods. Resolved, Upon Mr. Nicholson's report of the twenty-first of January, 1783, in favor of William Evans. E quire, that Council cannot consent to discharge Mr. Evans' account of expenditures, amounting to three hundred and eighteen pounds eighteen shillings and six pence in specie, but have every disposition to accommodate him with that sum in State money. Ordered, That passports to New York be granted to Jacob Morris, James Thompson, John Le Telier, and Daniel Charles Heath. Agreeably to a resolution of the General Assembly of the twentyfirst of March, 1783, authorizing Council to draw an order upon. the Treasurer of the State in favour of Henry Osbourne, Esquire, for as much money as they may think a proper compensation for his services in collecting evidence and other documents on the part of this State, in the late controversy with Connecticut, an order was drawn on the Treasurer in favour of the said Henry Osbourne, for the sum of sixty-eight pounds five chillings. A deed was examined and signed by his Excellency the Presi dent, conveying to Solomon Myers Cohen, lot No. 1696, in the city of Philadelphia, sold agreeable to law, for redemption of the bills of credit of this State of the twenty-ninth day of April, 1780, for the sum of fifty-three pounds. Upon the memorial of Jacob Shallurs, it was ordered that he make out an exact brief of his, title to the lot described in the said ⚫ memorial. Upon the petition of Benjamin Norris, of the county of Philadelphia, convicted of keeping a tipling house contrary to law, Ordered, That the fine of five pounds adjudged to the use of the State be emitted. Upon the personal application of Elizabeth Kurtz, and the consideration of some official papers produced by her in support of her claim to a tract of land in the county of Northampton, Ordered, That a letter be written to Nicholas Depui, Esq'r, and others, the Justices of the Peace for the said county, expressive of the wishes of Council that the referrees appointed at the September term, 1780, be requested to proceed upon the business without delay. Ordered, That Thomas Smith and Lawrence Burrows be permitted to go into New York, by the way of Dobbs' Ferry, and to return. The Council met. PHILADELPHIA, Friday, April 4th, 1783. The Honorable James Cunningham, Christopher Hayes, Sebastian Levan, James Irvine, A state of the receipts & expenditures of publick monies upon warrants from the Superintendant of Finance, was read. The memorial of Jacob Shallus, accompanied with his brief of title to a lot of ground described in the said memorial, were received and read; and, Ordered, To be referred to the Surveyor, Secretary of the Land Office, and Receiver-General, for examination. Ordered, That the Secretary of Council be directed to employ an additional clerk to continue the register of certificates given by the Receiver General, and of patents granted in consequence. Upon the application of Francis Lewis, Jun'r, and Michael Morgan O'Brian, a passport to New York was granted to each. Ordered, That Mary Anderson have permission to go into New York, by the way of Dobbs' Ferry, (no fees paid.) Passports to New York were granted to John Leary, Jun'r, and Mary Yorke, of this city. A letter from Hillary Baker, Junior, requesting the opinion of Council upon a law enacted by the last General Assembly, bearing date the nineteenth day of March, 1783, was read, and referred to the Honorable the Judges of the Supreme Court. A deed was examined and signed by his Excellency the President, to John Wilcocks, for lots No. 5, 6, and 7, containing, together, thirty-two acres and eighty-two perches of land, situate on Province Island Sold agreeable to law, for nineteen hundred and fifty pounds and fifteen shillings of the bills of credit of this State of the twenty ninth day of April, 1780, which sum the said John Wilcocks hath paid to the Treasurer of the State. Honorable James Irvine, Sebastian Levan, John Piper, Henry Wynkoope, Esquire, appeared in Council, and took the oaths required by the Constitution to qualify him as a Judge of the High Court of Errors and Appeals. In consideration of the representations made to Council by the Honorable Thomas Mifflin, John Bayard, Esquire, and others, in favour of Samuel Castner, convicted of misdemeanors in aiding British prisoners to escape, Ordered, That the remaining part of the fine adjudged to be paid by him to the State be remitted. The Board of Property sitting to-day, the Honorable James Irvine was appointed to attend with the President. Upon cousideration, Samuel Miles, Esquire, was unanimously elected a Judge of the High Court of Errors and Appeals, and a commission ordered to be made out accordingly. Upon application of William Nichols, John Ross, Nathaniel Vawinkle and Joseph Richardson, Ordered, That a passport be granted to each to go into the city of New York, by the way of Dobbs' Ferry, and to return. Upon the petition of Joseph Richardson, convicted at a late Supreme Court of a misdemeanor in aiding British prisoners of war to escape, and sentenced to a fine of one hundred and fifty pounds specie, to be paid upon the second day of this instant, Ordered, That the Sheriff of the city and county of Philadel phia be authorized to indulge Joseph Richardson in not paying the said fine untill the first day of August next, taking sufficient secu rity for its discharge upon that day. William Henry, Esquire, Lieutenant of the city and liberties of Philadelphia, represented to Council "that he had hitherto supposed himself obliged by law to superintend the elections of Platoon as well as field officers of the militia, and now begged the opinion of Council thereon."
