Discussion occurred and Mr. Foley offered a substitute amendment to retain the language as printed in the bill and add on page 4, line 20, "Unless otherwise published on a regular basis by an agency of the United States,".

Discussion continued and without objection the Foley substitute amendment was agreed to.

Page 5, strike out lines 18 through 22 and insert in lieu
thereof the following:

"(2) The term 'average daily price for raw sugar imports'
means the average for the applicable period of the daily domestic
spot quotation or price for raw sugar reported by the New York
Coffee and Sugar Exchange, C.I.F. duty paid basis, including
fees, if any, imposed under the International Sugar Agreement,
adjusted to exclude any special import duty imposed under
this Act, at a United States port of entry north of Cape
Hatteras: Provided, however, That if no such daily domestic

spot quotation or price is reported for any market day or
days in the applicable period, the Secretary shall determine
for each such market day for use in calculating such average
daily market price for raw sugar which shall be the daily
world price quoted by the International Sugar Organization
for such market day (or if no such quotation is issued,
an equivalent price determined by the Secretary), in
United States cents per pound, F.0.B. and stowed Caribbean
basis, in bulk, adjusted to a C.I.F. duty paid basis by
adding estimated costs of delivery from Caribbean ports
to U.S.ports north of Cape Hatteras, including freight,
insurance, stevedoring, financing, weighing and
sampling and import duties, including fees, if any,
imposed under the International Sugar Agreement excluding

any special import duty imposed under this Act."

Discussion occurred and Counsel advised that the Department did not insist on the amendment at this time so the amendment was passed over without prejudice.

Page 5, strike out lines 23 through 25, and page 6,
strike out lines 1 and 2; and on page 6 renumber para-
graphs (4) through (9) as (3) through (8).

sugar' means sugar to be further refined or improved
in quality. The term 'refined sugar' means sugar not
to be further refined or improved in quality."

Page 11, lines 13 and 14, strike out "sugar (including,
but not limited to, refined sugar)" and insert in lieu
thereof "raw sugar".

Discussion occurred and without objection the amendment was agreed to.

Page 11, line 20, insert at the end thereof "There is
imposed on refined sugar entered during any supply year
quarter such special import duty as the Secretary

determines necessary to assure that the price objective

for the year shall be achieved.".

Discussion occurred and without objection the amendment was agreed to.

Page 11, line 22, strike out "duty" and insert in lieu
thereof "duties".

Discussion occurred and without objection the amendment was agreed to.

Page 11, line 23, insert after "duty" the phrase

"on raw sugar".

Page 12, line 18, insert at the end thereof "The special
import duty on refined sugar shall be adjusted appro-
priately at the time changes are made in the special
import duty for raw sugar in such amount as necessary
to assure that the price objective for the year is
achieved.".

Discussion occurred and without objection the amendment was approved.

Page 12, insert immediately after line 18, the
following:

"(3) Notwithstanding the foregoing provisions of
this section, if at any time during the sugar supply
year the Secretary determines that the special import
duties provided for under paragraphs (1) and (2) will
not assure that the price objective will be achieved
on the average during the supply year, the Secretary
shall determine the amount of such adjustments in the
special import duties as are necessary to achieve such
result.".

Page 12, line 19, redesignate paragraph (3) as para-
graph (4).

Page 13, line 2, insert "market" after "3d".

Page 13, immediately after line 4, insert the

following:

"(C) The Secretary shall announce any special

import duty adjustment required to be made under para-
graph (3), and shall certify such adjustment to the
President before the close of the 3d market day after
determining its amount.".

lieu thereof "5th".

"(3) Any special import duty adjustment certified

to the President under section 203(a)(3) shall be pro-
claimed by the President not later than the close of
the 5th market day after the adjustment determination
is made by the Secretary.".

Page 16, strike out lines 15 through 24, and page 17,
strike out lines 1 through 7, and insert in lieu thereof
the following:

"(a) Imposition. --If the Secretary determines that during
the first 6 months of any sugar supply year the weighted
average of the average daily prices for raw sugar imports
plus the special import duties which were in effect during
such period have been less than the market price objective
by more than .50 cents, or if the Secretary determines

after the first 6 months of any sugar supply year that
the price objective for that year will not be achieved
on an average basis by the special import duties in
effect during that year, the Secretary shall certify
to the President such quantitative restrictions on the
total amount of sugar and sugar-containing products which
may be entered during the balance of that sugar supply
year as the Secretary determines to be necessary to
achieve, in conjunction with the special import duties
imposed during the supply year concerned, the price
objective for the year on an average basis. Any quanti-
tative restrictions certified to the President shall be
proclaimed by the President not later than the close of
the 5th market day after the determination of the Secre-
tary together with a statement of factors which entered
into the determination of the Secretary.

"(b) Review. --If any quantitative restrictions are
in effect under this section, the Secretary shall review,
from time to time, the effect of such restrictions and
shall certify to the President such adjustments in the
restrictions as the Secretary determines are required to
achieve the relevant annual market price objective. The
President shall proclaim the adjustments in quantitative
restrictions as certified by the Secretary, not later
than the close of the 5th market day after the deter-
mination of the Secretary with a statement of the factors
which entered into such determination.".

within the meaning of this section".
