NATIONAL DEFENSE BONDS

AVAILABLE IN EMERGENCIES DURING 1919 AND 1920

AN ACT

TO AMEND SECTION 1 OF AN ACT ENTITLED AN ACT TO
PROVIDE A BOND ISSUE FOR THE PURPOSE OF PAY-
ING THE EXPENSES WHICH HAVE BEEN, OR MAY BE,
INCURRED FOR THE RAISING, MAINTENANCE, EQUIP-
MENT AND PREPARATION OF THE NATIONAL GUARD
OF THE STATE OF COLORADO TO ASSIST IN DEFEND-
ING THE UNITED STATES OF AMERICA IN WAR WITH
THE IMPERIAL GOVERNMENT OF GERMANY, AND PRO-
VIDING A GUARD OR FORCE TO MAINTAIN ORDER IN
THIS STATE AND DEFEND THE STATE DURING THE
YEARS 1917 AND 1918," AND TO CONTINUE DURING
1919 AND 1920.

Be It Enacted by the General Assembly of the State of Colorado · Section 1. That Section 1 of Chapter 9 of the Session Laws of Colorado extraordinary session of 1917 being an act entitled an act to provide a bond issue for the purpose of paying the expenses which have been or may be incurred for the raising, maintenance, equipment and preparation of the National Guard of the State of Colorado to assist in defending the United States of America in war with the Imperial Government of Germany and providing a guard or force to maintain order in this state and defend the state during the years 1917 and 1918, approved August 3rd, 1917, be and the same is hereby amended as follows:

"Section 1. The Governor, the Treasurer and the Sec- Bond issue retary of State of Colorado are hereby authorized and instructed to issue negotiable coupon bonds of the State of Colorado in the sum of two million five hundred thousand dollars ($2,500,000), or so much thereof as may be necessary, as hereinafter set forth, for the purpose of paying the expenses which have been or may be incurred for the raising, maintenance, equipment and preparation of the National Guard of the State of Colorado to assist in defending the United States of America in war with the Imperial Government of Germany and for the purpose of providing a guard or force to maintain order in this state and defend the state during the years 1917, 1918, 1919 and 1920.

Said bonds shall be of the denomination of one hun- Denomination dred dollars ($100) each or any multiple thereof.

Said bonds shall be dated September 1, 1917, and Date shall be due and payable serially at the office of the State Treasurer of the State of Colorado as follows:

One hundred twenty-five thousand dollars $125,000) on the first day of September of each year from 1922 to 1941, both inclusive, unless said bonds shall have been previously redeemed or purchased for redemption.

Said bonds shall bear interest at the rate of four and Rate of interest one-half (42) per centum per annum, the interest to be evidenced by coupons attached to such bonds, payable semiannually on March 1 and September 1 of each year, at the office of the State Treasurer of the State of Colorado, or at such banking house in the City of New York as the State Treasurer may designate.

par and accrued interest, in payment of any part or all of any amounts appropriated by the General Assembly from the 'Defense Fund, National Defense Bonds, Series 1917,' for any of the purposes set forth in Section 1 of this act. The State Treasurer of the State of Colorado is hereby authorized, empowered and directed to buy all or any part of the bonds issued from time to time, as herein provided, as may in his judgment be for the best interest of the state, and pay for the same out of any money belonging to the permanent school fund or any other permanent or investment fund in his hands, and such bonds so bought by the State Treasurer shall be registered by the State Auditor and the State Treasurer in the name of and for the benefit of and payable only to the said fund with which they shall have been bought, and any bonds so bought by the State Treasurer with the permanent school fund shall have the words 'not transferable' plainly stamped across the face thereof.

All bonds issued hereunder shall be registered in the office of the Auditor of State, and the certificate of the Auditor of such registry, attested by his seal of office, attached to each bond, shall be evidence of the legal issue."

NATIONAL GUARD

APPOINTMENT OF ADJUTANT GENERAL

AN ACT

TO AMEND AN ACT ENTITLED "AN ACT TO AMEND SEC-
TION SIX (6) OF THE ACT ENTITLED 'AN ACT CON-
CERNING THE ORGANIZATION OF THE ORGANIZED
MILITIA, FIXING THE SALARY OF THE ADJUTANT
GENERAL, AND ABOLISHING CERTAIN OFFICES AND
DEPARTMENTS, AND TO REPEAL ALL ACTS AND
PARTS OF ACTS IN CONFLICT WITH THE PROVISIONS
OF THIS ACT,' APPROVED APRIL 12, 1915," APPROVED
MARCH 16, 1917.

Be It Enacted by the General Assembly of the State of Colorado:

Section 1. Section 6 of Chapter 101 of the Session Section amended Laws of 1917 being an act entitled "An act concerning the organization of the organized militia, fixing the salary of the Adjutant General and abolishing certain offices and departments, and to repeal all acts and parts of acts in conflict with the provisions of this act," approved April 12, 1915, is hereby amended so as to read as follows:

Section 6. The Adjutant General and all field and staff officers shall be appointed by the Governor. The Adjutant General and all field officers shall be appointed from persons who served as commissioned officers in the National Guard of Colorado, or from persons who are citizens of the State of Colorado and have served as commissioned officers in the army of the United States.

Staff officers, including officers of the Pay, Inspection, Subsistence and Medical Departments, hereafter appointed shall have had previous military experience and shall hold their positions until they shall have reached the age of sixty-four years, unless retired prior to that time by reason of resignation, disability, or for cause to be determined by a court martial legally convened for that purpose, and that vacancies among said officers shall be filled by appointment from officers of the militia of the State of Colorado.

Section 2. All acts and parts of acts in conflict herewith are hereby repealed.

Section 3. The General Assembly hereby declares that this act is necessary for the immediate preservation of the public peace and safety.

Section 4. In the opinion of the General Assembly an emergency exists; therefore this act shall take effect and be in force after its passage.
