such application that the case is a proper one to receive into the hospital, and that there is room for applicant, he shall determine the cost per capita per month for the care and treatment of patients in the hospital at the time such application is made, and shall require the applicant to pay such sum of money for one month's treatment in advance, and shall thereafter from month to month, so long as the patient may remain in the hospital, require the payment of such monthly fee in advance. Such fee may be from time to time increased or reduced, as, in the opinion of the superintendent, the expense of care and treatment of patients in the hospital is increased or diminished. Whenever any such patient is discharged from the hospital other than at the end of a month for which he has paid in advance, there shall be returned to the patient the pro rata amount of his last payment for the unexpired portion of the month.

Section 4. The Board of Regents of the University of Board of Colorado shall have full control and supervision of all the property and over the grounds and buildings of the institution, and shall have the entire government and management of the same. They shall prescribe and publish all rules, regulations and by-laws for the management of the affairs of the hospital and of its inmates, and for the government of its officers and employes, and shall make proper provision for the reception, treatment, discharge and transfer either from or to other institutions, or from the hospital to family care, and the return therefrom of all inmates who may be committed to the hospital. The superintendent shall keep in a book provided for that purpose a full and complete record of their acts and doings as such board, in which book, among other things, shall be kept the date of each visitation at the hospital by the board in a body, or by individual

members thereof, and the general condition of the hospital and its inmates.

Section 5. After the adoption and approval of this act the said Board of Regents shall forthwith proceed to acquire land upon which to construct said hospital and laboratory; and after the conveyance of such land, shall proceed to advertise for proposals for furnishing the materials and doing the work necessary to complete the hospital and laboratory according to such plans and specifications as may be adopted by said Board of Regents, and to put the said hospital and laboratory in readiness at an early period for the reception and care of such patients as may be committed to said hospital under the provisions of this or any other act; and upon the reception of such proposals, they may in their discretion make contracts with such bidders as shall make proposals best conducive to the interests of the state, taking into consideration the price, time of performance and responsibility of any contractor, with such sureties as he may offer, which contracts, when executed, shall be deposited in the office of the Secretary of State.

Section 6. The Board of Regents shall appoint a superintendent, who shall hold office during their pleasure, and who shall be a physician and graduate of an incorporated medical college, who shall have had at least ten years' experience in the actual practice of his profession, and who shall have had at least five years' actual experience as a neuro-pathologist. The superintendent shall reside at the hospital, and shall give his entire time and attention to the discharge of his official duties and shall receive such compensation as shall be fixed by the Board of Regents. The Board of Regents may further provide for an assistant superintendent, who shall be a physician and graduate of an incorporated medical college, of at least five years' experience in the actual practice of his profession and one year's specialization in nervous and mental diseases, and for such other employes and medical assistants as may be necessary, and they shall prescribe their duties and fix their respective

compensation. All such assistants and employes shall be selected and appointed by the superintendent, subject to the approval of the Board of Regents, and they shall hold their positions subject to such rules and regulations as the Board of Regents may prescribe.

Section 7. The Board of Regents may lease, build or purchase a temporary building for immediate use to carry out the purposes of this act.

Section 8. It shall be the duty of the superintendent Superintendent of said hospital to report to the County Court committing county court any patient, the progress made in the treatment and cure of such patient, together with recommendation regarding such patient. Whenever, in the opinion of the superintend- Transfer of ent, it is advisable that any person committed by any County Court in the state to said hospital, should be transferred to the Colorado State Hospital, or other institution or place, he shall report the same to the Judge of the County Court by which said patient was committed, and shall within five days after making such report, transfer said patient to such place so recommended, unless otherwise ordered by the County Court by which said patient was committed to said hospital.

AN ACT

TO AMEND SECTION 1947 OF THE REVISED STATUTES OF 1908 OF THE STATE OF COLORADO, CONCERNING RECOGNIZANCES IN CRIMINAL CASES.

Be It Enacted by the General Assembly of the State of Colorado: Section 1. Section 1947 of the Revised Statutes of 1908 of the State of Colorado, concerning recognizances in criminal cases, is hereby amended so as to read as follows:

1947. It shall be the duty of the District Court, when any indictment shall be found as a true bill, or when any information shall be filed, to make an order fixing the amount of bail for each offense bailable by law, to be endorsed on the process by the clerk; and the clerk of the District Court, or the sheriff, coroner or other officer who shall arrest the accused person or persons, shall let the accused person or persons to bail upon his or her or their entering into a recognizance, with one or more sureties, in the sum or sums specified on said process, which recognizance shall be made to the people of the state, conditioned for the appearance of the accused person or persons on the first day of the next term of the District Court to be held in and for such county, to answer said indictment or information, and not depart the court without leave, which recognizance shall be signed by the persons entering into the same, and certified by the officer taking it. Every recognizance so taken is hereby declared to be valid and binding, and shall not be set aside or adjudged insufficient for want of form. Approved: February 17, 1919.

AN ACT

TO PREVENT THE DISPLAY OF THE RED FLAG IN PUBLIC
IN THE STATE OF COLORADO

Whereas, In the opinion of the General Assembly of Preamble
the State of Colorado the displaying of the Red Flag, the
emblem of anarchy, in public, or in any place where the
public are accustomed to congregate, or near, or upon the
public streets of any city or town, or near or upon any
public highway, or from public or private buildings, in the
State of Colorado, by any association, society, club, corpora-
tion, organization, or individual, tends to foment and cause
trouble and disorder, excites and encourages riots and law-
lessness, and inculcates disrespect for the laws of the United
States and of the State of Colorado, as well as for the Flag
of our Country, and thus endangers the peace and safety
of our people; therefore,

Be It Enacted by the General Assembly of the State of Colorado:
