AN ACT

TO AMEND CHAPTER 211 OF THE SESSION LAWS OF 1911.
ENTITLED AN ACT PROVIDING FOR THE LICENSING
OF STALLIONS AND JACKS USED IN PUBLIC SERVICE"
AND APPROVED MAY 29, 1911.

Be It Enacted by the General Assembly of the State of Colorado: Section 1. That Chapter 211 of the Session Laws of 1911 be and the same is hereby amended so as to read as follows:

Section 1. It shall hereafter be unlawful for any person, persons, company or corporation to stand any stallion or jack for public service in the State of Colorado without first having obtained from the State Board of Stock Inspection Commissioners a license authorizing such public service. Such license shall be issued by the Secretary of the said State Board of Stock Inspection Commissioners, who shall charge and collect a fee of five dollars ($5.00) for such license, and shall authorize the public service of such stallion or jack for the calendar year of the year issued and shall state whether the stallion so licensed is a pure-bred registered stallion or a grade stallion, as the case may be. Section 2. Before any license shall be issued for the Application for public service of any stallion or jack, an application shall be made therefor upon suitable blanks to be provided by the State Board of Stock Inspection Commissioners, and in case of a pure-bred stallion or jack, the application shall be accompanied by the certificate or registration and in case application of a grade stallion or jack the application shall be accompanied by an affidavit sworn to by either owner or breeder on suitable blank form provided by the State Board of Inspection Commissioners, giving all necessary information regarding the breeding of said grade stallion or jack, including the registry number of either parent and name of breeder. For the purpose of this act, a pure-bred stallion or jack is one that is registered in a book, recognized by the National Registry Board, and a grade stallion or jack is one whose either parent is registered in a book recognized by the National Registry Board. A stallion or jack whose parents are pure-bred but of different breeds shall be licensed as a grade.

The license shall state in large type that the animal License contain licensed is a Pure-bred Stallion or Jack, or that it is a Grade Stallion or Jack, as the case may be, and it shall give the breed, age, color, marking and name or names of breeder and owner.

Section 3. There shall accompany each application for a license a certificate from some licensed veterinarian of the State of Colorado or Federal veterinarian, stating that the stallion or jack sought to be licensed is not afflicted with any of the diseases or unsoundnesses known as roaring, ringbone, chorea (St. Vitus Dance, crampiness, shivering, string halt), bone spavin, bog spavin, specific ophthalmia (moon blindness), curb (when accompanied with curby conformation), or any form of venereal or other contagious diseases. Any stallion or jack that is a ridgling or that is deformed or afflicted with any of the diseases or unsoundness above mentioned shall not be imported into Colorado to be used for breeding purposes or if in the State, shall not be licensed

for service in the state, and it shall be unlawful for any person, persons, company or corporation to stand any such Legal veterinary stallion or jack for public service in this state; provided, that in securing the certificate from any licensed veterinarian on the examination of any such stallion or jack sought to be licensed, it shall be unlawful for any licensed veterinarian to charge more than three dollars ($3.00) and actual expenses as fee for such service.

Section 4. Should the attention of the State Veterinary Surgeon be called to the fact that any stallion or jack being stood for public service under a license as provided herein, is afflicted with any of the diseases named in Section 3 of this act, it shall be the duty of the State Veterinary Surgeon to make an examination of such animal, and if the animal is found to be so afflicted, it shall be the duty of the State Veterinary Surgeon to report the same to the State Board of Stock Inspection Commissioners, who shall revoke the license of said animal and cancel the same, and thereafter such stallion or jack so afflicted shall not be allowed to stand for public service in this state.

Section 5. The State Board of Stock Inspection Commissioners is authorized and instructed to use the money in the "Stallion Fund" each year for the purpose of enforcing this act and of offering special premiums at any fairs or stock shows held in this state to be competed for by horses, mules or colts owned in Colorado and exhibited at such fairs or stock shows, and said Board shall make such rules and regulations in regard to such premiums and the competition therefor, as will in their judgment best encourage the breeding of improved horses and mules in Colorado and the premiums offered shall be competed for under such conditions as will best produce that result. The State Board of Stock Inspection Commissioners shall at the close of each year, providing funds will permit, issue and distribute free of charge, a report of all stallions or jacks licensed during the year, giving their ownership, breed, age, location; the cost of printing and distribution shall be paid

Section 6. Any person who shall offer the breeding services of any stallion or jack to the public in this state, or make a charge for such service, shall have a license as provided herein and shall keep such license posted in a prominent place on or near the stall where the said stallion or jack is kept or if the stallion or jack is upon the road being vended for service, then the person in charge of said stallion or jack shall carry or exhibit such license to the owner in charge or care of any mare to be served by said stallion or jack, and such license must be shown for the inspection of any person desiring the service of the stallion or jack, or who may for any reason desire to see such license.

Section 7. The owner or owners of any licensed stal- Unpaid service lion or jack shall have a lien upon the get of any such stallion or jack until the service fee has been paid, and it shall be unlawful to sell or dispose of or remove from the county any colt upon which the owner of a licensed stallion or jack has a lien as provided for in this section without the written consent of such owner, nor shall any mare served by a licensed stallion or jack be sold or removed from the county prior to payment of service fee without the writ ten consent of the owner of the stallion or jack which served said mare.

Section 8. Any person, persons, company or corporation, who shall violate any of the provisions of this act, or who shall change the color markings of any stallion or jack, or give false verbal or written statements regarding the breeding of any stallion or jack with the intent to deceive, shall be deemed guilty of a misdemeanor and upon conviction thereof in any court of competent jurisdiction shall be
