FRIDAY, DECEMBER 15, 1843.

On motion of Mr. Dromgoole,

The further consideration of the resolution moved by Mr. Garrett Davis, on Wednesday last, to instruct the Committee of Elections to report whether the members from the States of New Hampshire, Georgia, Mississippi, and Missouri, have been elected in conformity to the Constitution and law, was postponed until to morrow.

On motion of Mr. Dromgoole,

The further consideration of the resolution moved by Mr. Barnard, on Tuesday last, to amend the journal of the preceding day, in relation to the amendment of the journal moved by Mr. Barnard on the 5th instant, was postponed until to-morrow.

The House again resumed the consideration of the resolution moved by Mr. Dromgoole on Monday, the 4th instant, that the rules and orders of the last House of Representatives be adopted as the rules and orders of proceeding of this House; the question being on the amendment thereto moved by Mr. Dromgoole on Monday last, and pending when the House adjourned on that day.

After debate,

The previous question was moved by Mr. Cave Johnson, and seconded by a member; when

Mr. Dromgoole submitted, as a question of order, that, at this stage of the proceedings, (that is, previous to the ordering of the main question,) the amendment submitted by him would not be set aside by the previous question.

The Speaker decided against the point of order raised by Mr. Dromgoole.

From this decision Mr. Dromgoole appealed.

And the question being put, Shall the decision of the Chair stand as the judgment of the House?

It was decided in the affirmative.

The question was then put, to wit: Shall the main question be now put? And decided in the affirmative.

The main question was then put, Shall the rules and orders of the last House of Representatives, as amended on Monday, the 4th instant, be adopted as the rules and orders of proceeding of this House?

And decided in the affirmative.

And so it was

Resolved, That the standing rules and orders of the last House of Representatives be adopted as the rules and orders of proceeding of this House, except so much of the 133d rule (edition of December 4, 1843) as is in the words following, viz: "But the House may, at any time, by a vote of a majority of the members present, suspend the rules and orders for the purpose of going into Committee of the Whole on the state of the Union; and also of providing for the discharge of the Committee of the Whole on the state of the Union from the consideration of any bill referred to it, after acting, without debate, on all amendments pending, and

that may be offered," until a committee of nine members, to be now appointed to revise the said rules and orders, shall make report, and said report be finally disposed of.

Mr. Wise, Mr. Adams, Mr. Dromgoole, Mr. Beardsley, Mr. White, Mr. C. J. Ingersoll, Mr. John W. Davis, Mr. Vinton, and Mr. R. Chapman, were appointed the said committee.

Mr. Dromgoole gave notice of a motion to amend the standing rules and orders of the House, by adding thereto the following: "It shall not be in order for any member, under cover of a proposition to correct the journal, to move to spread on the journal any paper or document which the House has previously refused to receive or hear read. When motions are made to correct or amend the journal by the insertion of papers or documents therein, if the House shall not decide in favor of the proposition, the matter proposed to be inserted shall not be spread on the journal, notwithstanding the yeas and nays may be entered on the journal."

Mr. Giddings gave notice of a motion to amend the standing rules and orders of the House, as follows: Add to the 23d rule the following: "provided nothing herein contained shall be so construed as to prohibit the suppression of any petition, memorial, resolution, or other paper, seeking the repeal of any existing act of Congress heretofore passed."

Mr. Levy moved the following resolution; which was read, and the rule requiring the same to lie on the table one day being dispensed with, it was considered and agreed to, to wit:

Resolved, That the Secretary of the Navy be required to report to this House what buildings and other structures there are at the Pensacola navy-yard, and the cost thereof; what further improvements are required to complete it as a yard for construction and repair of vessels of war, with estimates therefor; what plans for the improvement of said yard have been reported to his department by engineers employed for the purpose; whether the said navy yard is in a condition to furnish repairs or supplies to vessels of any class requiring the same; what amount of appropriation (specifying the appropriations under their respective heads) has been made in each year, for the improvement of said yard, since its establishment; what number and description of vessels are employed as a naval force in the Gulf of Mexico and its neighboring waters; and what amount of appropriation has been made for the naval service, in each year, since the adoption of the Constitution.

On motion of Mr. Joseph R. Ingersoll,

Resolved, That the Committee of Ways and Means be instructed to inquire into the expediency of introducing a bill to levy duties upon the importation of tea and coffee.

Mr. Joseph R. Ingersoll moved the following resolution; which was read, and the rule requiring the same to lie on the table one day being dispensed with, it was considered and agreed to, to wit:

Resolved, That the President be requested to cause to be furnished to this House such information as may be on file in any of the departments relative to the formation of a junction between the Atlantic and Pacific

oceans.

A motion was made by Mr. McKay that ten thousand copies, extra, of the report of the Secretary of the Treasury upon the finances, be printed.

A motion was made by Mr. David L. Seymour to amend the said motion, by striking out "ten thousand," and inserting "fifteen thousand." And the question was put, Will the House agree to the amendment moved by Mr. Seymour?

And decided in the negative.

The motion of Mr. McKay was then agreed to.

Mr. Houston gave notice that he would, to-morrow, or on some future day, ask leave to introduce a bill to reduce and graduate the price of the public lands in favor of settlers and cultivators.

Mr. Jameson gave notice that he would, to-morrow, or on some future day, ask leave to introduce "a bill to repeal so much of the act approved the 23d day of August, 1842, as requires the second regiment of dragoons to be converted into a regiment of riflemen after the 4th day of March, 1843;" and, also, "a bill making an appropriation for the pay of horses lost by the Missouri volunteers in the Florida war."

Mr. Stiles rose and announced that John Millen, a member elect of this House, from the State of Georgia, died at his residence in that State on the 15th day of October last.

And thereupon,

On motion of Mr. Stiles, it was

Resolved, unanimously, That this House has received with deep sensibility the communication of the death of John Millen, a Representative of the State of Georgia.

Resolved, That the members of this House will testify their respect for the memory of the deceased, by wearing crape on the left arm for thirty days.

Resolved, As a further testimonial of respect for the memory of the deceased, this House will now adjourn.

Ordered, That the Clerk inform the Senate thereof.

And thereupon,

The House adjourned until to-morrow, 12 o'clock meridian.

Mr. Aaron V. Brown gave notice of a motion for leave to introduce a bill to repeal so much of the act apportioning Representatives amongst the several States, approved 25th June, 1842, as requires the number to which each State is entitled to be elected by districts.

On motion of Mr. McKay,

Resolved, That the report of the Secretary of the Treasury, on the state of the finances, be referred to the Committee of Ways and Means.

A motion was made by Mr. John W. Davis, that the election of Chaplain be postponed for the present, in order to enable his colleague (Mr. Pettit) to introduce a resolution relative to the subject under consideration; Which was decided in the negative.
