§ 6. The corporation created by the act entitled "An act au- Bridge made thorising Nathan A. AN ACT to fix the time and place for holding the annual town meeting in the town of Colesville, county of Broome.

The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

§ 1. The next annual town meeting in the town of Colesville, county of Broome, shall be held at the tavern house of Wiley H. Scott, in the village of Nineveh, in said town, on the second Tuesday of February, one thousand eight hundred and forty-nine.

§ 2. This act shall take effect immediately.

AN ACT to designate the place of holding the next annual town meeting in the town of Seward in the County of Schoharie.

The People of the State of New York represented in Senate and Assembly do enact as follows:

§ 1. The next annual town meeting in the town of Seward in the County of Schoharie shall be held at the house of Matthias Houghtailing in said town.

§ 2. This act shall take effect immediately.

AN ACT to amend the charter of the Washington Monument
Association of the city of New-York.

Passed February 2, 1849.

The People of the State of New-York, represented in Senate and Assembly do enact as follows:

§ 1. The provisions of section five of the "Act to incorporate commenced. the Washington Monument Association of the city of New York," passed April 18, 1843, is hereby so modified as to authorize the said association to commence the erection of the said monument at any time, with such sum of money in hand as in their discretion they may deem advisable.

from the meetings of the board of trustees during the space of

six consecutive months, may be declared vacant by a vote of a quorum of the remaining trustees.

§ 3. The Trustees of the Association, shall, once in every six Statement to be published months, make and publish a statement in at least two of the daily newspapers published in the city of New-York, of all expendi tures made by them as such trustees specifying the items of expenditure and to whom paid.

4. That portion of section two of the act of April 18th Repeal. 1843, which requires that Trustees shall reside in the city of New-York is hereby repealed.

AN ACT to authorise the election of a supervisor in each ward in the city of Utica.

The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

§ 1. At the next and each succeeding charter election in the Supervisors. city of Utica, each ward in said city shall be entitled to elect a

supervisor.

AN ACT authorising the comptroller to receive the returns of certain unpaid taxes on non-resident lands in the town of Bleecker, for the year 1847.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

§ 1. Chap. 28.

AN ACT to provide for filling vacancies in office.*

The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

§ 1.

Whenever vacancies shall exist or shall occur in any of filled by the the offices of this state, where no provision is now made by law for filling the same, the governor shall appoint some suitable person who may be eligible to the office so vacant or to become vacant, to execute the duties thereof until the commencement of the political year next succeeding the first annual election, after the happening of the vacancy at which such officer could be by law, elected; and the person so appointed to fill such vacancy, shall possess all the rights and powers, and be subject to all the liabilities, duties and obligations of such officer as they are now or may hereafter be prescribed by law, but nothing in this act contained shall authorise the governor to fill a vacancy in the office of county judge, and surrogate or either of them, where provision is made by law for the election of local officers under the fifteenth section of article six of the constitution of this state: Provided, however, that when a vacancy exists in the office s of secretary of state, comptroller, treasurer, attorney general, state engineer and surveyor, clerk of the court of appeals, or canal commissioner, while the legislature is in session, the two houses thereof, by joint ballot, shall appoint a person to fill such vacancy; and any person appointed by the governor (except state prison inspector) may be removed from such office, by concurrent resolution of both houses of the legislature. On such removal both houses shall, forthwith, by joint ballot, appoint a person to the office made vacant thereby.

Chap. 29.

AN ACT making an appropriation to the New-York Institution for the Instruction of the Deaf and Dumb, to enable them to pay off their debt.

Passed February 5, 1849, "three-fifths being present." The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

§ 1. The treasurer shall pay on the warrant of the comptroller to the treasurer of the New-York Institution for the instruction of the Deaf and Dumb, the sum of fifteen thousand dollars, or so much as may be necessary to enable said Institution to extinguish the debt incurred for the erection of buildings.
