of Genesee Falls, Wyoming county, included in and described as a part of the lands.so conveyed by William Pryor Letchworth to the people of the state of New York by a deed executed on the thirty-first day of December, nineteen hundred and six, is hereby ratified and confirmed, so as to give said deed the same force and effect as if such action of the Wyoming benevolent institute had been expressly authorized by law before the execution of said deed. All lands described in and covered by said deed of William Pryor Letchworth shall be deemed to be in the actual possession of the comptroller of this state, subject to such life use and tenancy of said grantor. After the death of the grantor, the American scenic and historic preservation society shall have control and jurisdiction thereof for the purposes stated, unless the supreme court shall determine otherwise for good cause shown upon application of the comptroller, or some other duly authorized official of the state.

§ 2. This act shall take effect immediately.

Chap. 2.

AN ACT to confirm the election in Malone village for, and the acts of the board of trustees of said village in, the purchase of the water works system of said village, and to authorize the said board of trustees to issue bonds for the purpose of paying the bond of the village falling due April first, one thousand nine hundred and seven, and the bonds the village assumed as a part of the purchase price of its said system of water works.

Became a law, January 31, 1907, with the approval of the Governor. Passed, three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. The special election held in and for Malone village, Franklin county, New York, on the twenty-first day of August, one thousand nine hundred and six, and the propositions submitted and adopted at such election providing for the purchase by Malone village of the water works system and property of the Malone water works company, and authorizing the issue of

the bonds of said village to the amount of two hundred and twenty-five thousand dollars for the purpose of borrowing money to pay for said water works system and property, and all the acts of the board of trustees in purchasing said water works system and issuing a bond upon the credit of said village, dated October first, one thousand nine hundred and six, and payable April first, one thousand nine hundred and seven, bearing interest at five per cent, and the purchase of said water works system and property and the payment therefor with the proceeds of said bond and all the acts of the board of trustees of said village before and after said election in reference thereto, are hereby in all respects legalized, ratified, and confirmed.

2. The board of trustees of Malone village is hereby authorized and empowered to issue bonds upon the credit of said village to the amount of two hundred and twenty-five thousand dollars, for the purpose of borrowing money thereon, to be used in payment of the amount unpaid on said bond of the village which is to fall due April first, one thousand nine hundred and seven, and a bonded indebtedness against said water works system and property at the time of the purchase which was assumed by the village as a part of said purchase price. Such bonds shall be issued in the name of Malone village, shall be signed by its president and treasurer and attested by the clerk under the corporate seal, and shall bear interest at a rate not exceeding five per cent, payable annually or semi-annually, as the board of trustees may determine. The bond shall be issued in pursuance of a resolution of the board of trustees, and shall be of such denominations and of such description as the board of trustees shall determine, but shall provide for the payment of the whole amount within sixty years from the date of issue in equal, annual installments, the first to be paid not more than five years from the date of issue and the last not more than sixty years from the date thereof.

§3. When the board of trustees shall, by resolution, determine so to issue said bonds, public notice inviting proposals for the purchase thereof shall be given by publication in the official newspaper or newspapers of the village, and in such other newspaper or newspapers as the board of trustees may prescribe, and such notice shall state that, at a time and place therein named, the board of trustees will receive sealed proposals for the purchase of said bonds, and shall award the bonds to the person who will take them at the lowest rate of interest, but the board of trustees

shall have power to reject any bid. The bonds shall not be sold for less than their par value.

4. The moneys received from the sale of such bonds shall be used to pay the indebtedness of said Malone village, made in consequence of the purchase as aforesaid of the said Malone water works company's system and property.

5. This act shall take effect immediately.

Chap. 3.

AN ACT to legalize and validate certain bonds of the village of Scotia and proceedings heretofore taken for the issuance and sale thereof by the board of trustees and legal voters of said village, and to provide for the delivery or resale thereof and for the levy of a tax for the payment of the principal and interest thereof.

Became a law, February 1, 1907, with the approval of the Governor. Passed, three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. The proposition adopted at the annual election held in the village of Scotia, Schenectady county, on March twentieth, nineteen hundred and six, authorizing the issuance of five thousand dollars, village hall bonds, and the two propositions adopted at a special election held in said village on July twenty-eighth, nineteen hundred and six, authorizing respectively the issuance of seventeen thousand dollars, drainage bonds, and twenty-seven thousand dollars, water bonds of such village, and all proceedings theretofore and thereafter taken by the board of trustees of said village relative to the issuance and sale of said bonds respectively in the several amounts aforesaid, dated September fifteenth, nineteen hundred and six, are hereby in all respects legalized and validated.

§ 2. The said drainage bonds in the amount of seventeen thousand dollars, dated September fifteenth, nineteen hundred and six, and denominations of one thousand dollars, each, maturing as follows: Five thousand dollars, August first, nineteen hundred and nine, six thousand dollars, August first, nineteen

hundred and ten, six thousand dollars, August first, nineteen hundred and eleven: with interest at the rate of four and ninetyhundredths per centum per annum, payable semi-annually, on the first days of February and August in each year until several maturities thereof, are hereby authorized and declared to be, when issued, the legal and valid obligations of the village of Scotia.

3. The said village hall bonds in the amount of five thousand dollars, dated September fifteenth, nineteen hundred and six, in denominations of one thousand dollars, each, maturing as follows: One thousand dollars, August first, nineteen hundre and nine, two thousand dollars, August first, nineteen hundred and ten, and two thousand dollars, August first, nineteen hundred and eleven: with interest at the rate of four and ninetyhundredths per centum per annum, payable semi-annually on the first days of February and August in each year until the several maturities thereof, are hereby authorized and declared to be, when issued, the legal and valid obligations of the village of Scotia.

84. The said water bonds in the amount of twenty-seven thousand dollars, dated September fifteenth, nineteen hundred and six, in denominations of one thousand dollars, each maturing serially one thousand dollars each year from August first, nineteen hundred and nine to August first, nineteen hundred and thirty-five both inclusive, with interest at the rate of four and ninety-hundredths per centum per annum, payable semi-annually, on the first days of February and August in each year until the several maturities thereof, are hereby authorized and declared to be, when issued, the legal and valid obligations of the village of Scotia.

5. The president and treasurer of said village are hereby authorized to execute and deliver each of said series of bonds upon payment of the purchase price therefor, said bonds to be executed under the corporate seal of the village, attested by the village clerk. Should the sale of said several series of bonds heretofore made for any reason not be consummated, the board of trustees may re-advertise the sale of said bonds or any of them pursuant to section one hundred and twenty-nine of the village law, bearing such rate of interest not over five per centum per annum, payable annually or semi-annually as may be bid thereon. That said bonds shall in no event be sold for less than par.

§ 6. The board of trustees shall annually levy a tax sufficient to pay interest and maturing principal of each of said series of bonds.

§ 7. This act shall not affect any action or proceeding now pending in any court.

§ 8. This act shall take effect immediately.

Chap. 4.

AN ACT to legalize, confirm and validate certain conveyances made by the trustees of the village of Ellenville, in the county of Ulster and certain conveyances made to the trustees of the village of Ellenville, in the county of Ulster.

Became a law, February 2, 1907, with the approval of the Governor. Passed, three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. All of the following certain deeds of conveyance, to wit, the certain deed of conveyance made by John R. DeVany and Lizzie D. DeVany, his wife, of Ellenville, New York, to the board of trustees of the village of Ellenville, New York, bearing date May second, nineteen hundred, to a certain tract of land situate in the town of Wawarsing, in said county of Ulster and recorded in Ulster county clerk's office on the fifth day of December, nineteen hundred, in liber three hundred and sixty-two of deeds at page two hundred and fifty-four; the certain deed of conveyance bearing date August twenty-fourth, nineteen hundred and one, made and executed by Jacob M. DeWitt and Margaret DeWitt, his wife, of Ellenville, New York, to William S. Doyle, William Booth, Frank J. Potter, Herman S. Wells, M. Eugene Clark and Myron C. Wood, as present trustees of the village of Ellenville, New York, to a certain tract of land situate in the town of Wawarsing, county of Ulster aforesaid and recorded in Ulster county clerk's office on the ninth day of August, nineteen hundred and two, in liber three hundred and seventy-two of deeds at page three hundred and forty; the certain deed of conveyance bearing date May seventh, nineteen hundred and three, made and executed by Uriah E. Terwilliger and Alice A. Terwilliger, his
