Unreported opinions [reparation cases]

[Nos. 1-28 of this series as originally printed bore reported Opinion nos. 1067, 1069-74,
1076-81, 1083-86, 1088-96, 1098, 1097, respectively. These regular reported Opin-
ion numbers were canceled and Unreported opinion numbers 1-28 substituted
therefor by rubber stamp. Beginning with no. 29, the correct numbers were
printed on the publications.
A limited number of Unreported opinions 1-113 were bound as a companion volume
to v. 17 of Interstate Commerce Commission reports (IC161:17) to which they
correspond in point of time, although not included therein. The Unreported
opinions bear the words "Report and order of commission." They have sepa-
rate pagination and by this means are distinguishable from the reported
opinions contained in v. 17 (IC1.61:17).

Although this Checklist ends with 1909 publications, an exception to the general
rule has been made so as to include both unreported opinions 67-113 of 1910 and
the index to nos. 1-113, which appeared in Mar. 1910.

The "Opinion" numbers originally assigned to 1-28 of this series, as noted above, were reassigned to later reported opinions, all in v. 17 of Interstate Commerce Commission reports (IC1.61:17).]

J. JUSTICE DEPARTMENT

[Ir. sec. 35 of "An act to establish the judicial courts of the United States," approved Sept. 24, 1789, provision was made for the appointment of an Attorney-General "whose duty it shall be to prosecute and conduct all suits in the Supreme Court in which the United States shall be concerned, and to give his advice and opinion upon questions of law when required by the President of the United States, or when requested by the heads of any of the Departments, touching any matters that may concern their Departments . . ." (Stat. L. v. 1, p. 92).

But it was not until July 1, 1870, by act approved June 22, 1870 (Stat. L. v. 16, p. 162), that the Department of Justice was organized as an Executive Department, with the Attorney-General at its head. To this Department the legal advisers then attached to other departments were transferred, and the jurisdiction which the Secretary of Interior held over the accounts of the district attorneys, marshals, clerks, and other officers of the courts of the United States, was ordered to be exercised by the Attorney-General.]
