the schedule approved as herein provided or in an emergency from operating temporarily reserve vehicles on such routes and schedules approved as aforesaid for the public accommodation. The license, or registration fees charged under this Act shall be on the basis of the entire year, but may be issued on or after the first day of July in any year for the remainder of the year expiring on the thirty-first day of December, in which event one-half of the yearly fee shall be paid. No portion of the license or registration fee paid as aforesaid will be refunded for any part of the year during which said license is not used.

471. It shall be the duty of the Motor Vehicle Commissioner to keep a separate account of all moneys collected under this Act, and any and all moneys so collected shall be accounted for and remitted by the Motor Vehicle Commissioner to the State Treasurer on or before the first day of May of each year, along with a statement showing the amount due the State Roads Commission on account of all moneys so collected for the use of State and State aid roads, and must further show the amount due the respective Boards of County Commissioners for the use of all improved county roads, and also the amounts due the mayors of the respective towns and cities in the State of Maryland for the use of all streets and roads in said towns and cities, the amounts so due in each case to be computed upon a mileage basis, and said State Treasurer shall create a special fund thereof and on the fifteenth day of May in each year shall pay, on warrant, to the State Roads Commission of Maryland all moneys so collected for use of State and State aid roads, to the respective Boards of County Commissioners all moneys collected for the use of improved county roads, and to the mayors of the respective towns and cities in the State of Maryland ail moneys collected for the use of the roads and streets of said towns and cities, and all such moneys so collected shall be used for the maintenance of said roads and streets over which said motor vehicles shall operate.

472. It shall be the duty of the Public Service Commission of Maryland, upon the application of any motor vehicle owner

for a permit to operate any motor vehicle for the public transportation of passengers over any specified route, to investigate the feasibility of granting said permit, the number of motor vehicles to be used, the rate to be charged, and if, in the judg ment of the Public Service Commission it is deemed best for public welfare and convenience that said permit should be granted, said Public Service Commission is hereby empowered and authorized to grant such permit, but if said Public Service Commission deems the granting of such a permit prejudicial to the welfare and convenience of the public, then the said Public Service Commission is hereby empowered and authorized to refuse the granting of same. The said Public Service Commission of Maryland is further empowered and authorized to make such rules and regulations as it may deem necessary to govern the control and operation of same, and enforce the same by such penalties or forfeitures as it may prescribe, including the revocation of the permit granted under the provisions of this Act.

473. Every person owning or operating any such motor ve‐ hicle in violation of any of the provisions of this Act, or in violation of the rules and regulations aforesaid of the Public Service Commission, shall be deemed guilty of a misdemeanor and, upon conviction, subject to a fine of not less than five dollars nor more than fifty dollars for the first offense, and a fine of not less than ten dollars nor more than one hundred dollars for each additional offense or subsequent offenses.

474. All Acts or parts of Acts inconsistent therewith are hereby repealed to the extent of said inconsistency, but that nothing herein shall be construed to relieve any owner or operator of such motor vehicles as are herein defined from any regulation otherwise imposed by law or lawful authority.

Motor Vehicles for Public Transportation of Merchandise*

1916, ch. 714, sec. 1.

475. It shall be the duty of each owner of a motor vehicle to be used in the public transportation of merchandise or freight, operating over State, State aid, improved county roads, and streets and roads of incorporated towns and cities in the State of Maryland, to secure a permit from the Public Service Commission of Maryland to operate over said roads and streets, and present same to the Motor Vehicle Commissioner annually at the time and according to the method and provisions prescribed by law for owners of all other motor vehicles to make an application in writing for registration with the Commissioner of Motor Vehicles, and to state in said application, besides the other matters by law provided, the carrying capacity as given by manufacturer of such motor vehicles, the route on which said motor vehicle is to be used, whether reserve or substitute cars are maintained by the applicant to be used only in emergencies, and if so, the number of such reserve and substitute cars and a complete description of each, and when in use same to be designated by a special marker to be furnished by the Commissioner of Motor Vehicles, the length of the route in miles on State, State aid, improved county roads, and streets and roads of incorporated towns and cities, the weight of the vehicle when empty, the schedule under which it shall operate during the ensuing year, and for all such motor vehicles, except reserve or substitute vehicles, the following annual fees shall be paid to the Commissioner of Motor Vehicles for certificates of registration issued by him, and no other additional fees, license or tax shall be charged by the State or any municipality thereof, except property tax in respect to such vehicles or their operation:

Class "X." Motor vehicles weighing three (3) tons or less, including the carrying capacity, shall each be charged and pay one-twelfth (1/12c.) of a cent per each ton mile, multiplied by the total number of miles that said application shall show will be traveled by such motor vehicle over State, State aid, improved county roads, and streets and roads of incorporated

towns and cities in the State of Maryland during the year for which said certificate is issued.

Class "Y." Motor vehicles weighing not over six (6) tons and not less than three (3) tons, including carrying capacity, shall each be charged and pay one-tenth (1/10c.) of a cent per each ton mile, multiplied by the total number of miles that said application shall show will be traveled by such motor vehicle over State, State aid, improved county roads, and streets and roads of incorporated towns and cities in the State of Maryland during the year for which said certificate is issued.

Class "Z." Motor vehicles weighing over six (6) tons, includ ing carrying capacity, shall each be charged and pay one-eighth (c.) of a cent per each ton mile, multiplied by the total number of miles that said application shall show will be traveled by such motor vehicle over State, State aid, improved county roads, and streets and roads of any incorporated towns and cities in the State of Maryland during the year for which said certificate is issued.

476. Each and every such motor vehicle so registered shall operate only on the route and schedule set forth in said application during the year for which said license is issued. It shall be the duty of the Motor Vehicle Commissioner, upon the presentation of a permit from the Public Service Commission of Maryland, authorizing the motor vehicle owner to operate on a certain route, to furnish the motor vehicle owner with a distinguishing plate or marker, which, in addition to the other matters otherwise by law provided to be placed thereon, shall bear the letter stating the class under which such vehicles shall operate, such as X-No......, Y-No......, and Z-No...... No such motor vehicle owner shall change said schedule or route of his motor vehicle during any year for which a certificate has been issued, without a permit, in writing, made in duplicate, from the Public Service Commission of Maryland, a copy of which shall be sent to the Motor Vehicle Commissioner before said schedule is changed, whereupon a proper readjustment of charges shall be made upon the basis aforesaid; but nothing

in this Act shall be construed to prevent an owner or operator of such regularly licensed vehicles from replacing in an emergency such vehicles by a substitute vehicle in order to maintain the schedule approved as herein provided, or in an emergency, from operating, temporarily, reserve vehicles on such routes and schedules approved as aforesaid for the public accommodation. The license, or registration fees charged under this Act shall be on the basis of the entire year, but may be issued on or after the first day of July in any year for the remainder of the year expiring on the thirty-first day of December, in which event one-half of the yearly fee shall be paid. No portion of the, license or registration fee paid as aforesaid will be refunded for any part of the year during which said license is not used.

477. It shall be the duty of the Motor Vehicle Commissioner to keep a separate account of all moneys collected under this Act, and any and all moneys so collected shall be accounted for and remitted by the Motor Vehicle Commissioner to the State Treasurer on or before the first day of May of each year, along with a statement showing the amount due the State Roads Commission on account of all moneys so collected for the use of State and State aid roads, and must further show the amount due the respective Boards of County Commissioners for the use of all improved county roads, and also the amounts due the mayors of the respective towns and cities in the State of Maryland for the use of all streets and roads in said towns and cities, the amounts so due in each case to be computed upon a mileage basis, and said Treasurer shall create a special fund thereof and on the fifteenth day of May in each year shall pay, on warrant, to the State Roads Commission of Maryland all moneys so collected for the use of State and State aid roads, to the respective Boards of County Commissioners all moneys collected. for the use of improved county roads, and to the mayors of the respective towns and cities in the State of Maryland all money's collected for the use of the streets and roads of said towns and cities, and all such moneys so collected shall be used for the maintenance of said roads and streets over which said motor vehicles shall operate.
