C. Sampling Schedule

Water samples for Bateriological Analysis will be collected
monthly. As prescribed by the Indian Ilealth Service and
Environmental Protection Agency.

A. The Organization will maintain a complete and up-to-date record of all customers served by the systems operated by the Organization. Additions and deletions will be made as soon as the organization is notified of changes.

The Organization will type and mail to each customer his bill for services on the 1st day of the month. Payment will be due on the 10th day of the month. Non-Payment by the 25th day of the month will be cause for the Organization to discontinue service to the customer. C. Customers may make payments by cash, check, or money order to the Organization at its office or to its honded agent in the field. In either case, the customer will receive a signed and dated receipt.

D. Customers occupying homes managed by the Housing Authority will continue to make water and sewer payments along with their rent or house payment. The Housing Authority will pay the Organization for all housing occupants and a receipt will be issued to the Housing Authority.

E. Customers requesting new services, reconnection, plumbing repair,
well repair or septic tank pumping will make arrangements with the
Organization for payment prior to receiving the services.

F. If a custmcer's water service is disconnected, he must pay all delinquent charges plus the reconnection fee before the Organization will resotre his water service.

ENFORCEMENT

A. The Leech Lake Maintenance Organization is authorized by the Leech Lake RBC to collect fees for water and sewer service provided and to shut off services for non-payment.

B. The Organization shall enforce its regulations and fee collections
by shutting off water service of any and all violaters and delinquent
bill-payors. They will not seek to attach customer's property, nor
seek to have fines assessed by the Court System, except in limited
cases of blatant or continued abuses or distruction of property.

BOOKKEEPING AND HANDLING OF FUNDS

A. The Organization will follow normal. RBC procedures for bookkeeping and banking. This will allow convenient handling of funds through the same bank account of the RBC, whiel also providing a separate accounting of the Organization funds

B. Actual handling of the Organization funds will be performed by the
RBC Treasurer, or his designated agent.

C. All accounts and ledgers of the Organization shall be available for
audit at any time by the RBC Auditor.

CUSTOMER COMPLAINTS AND PROBLEMS

The Organization should serve the people of the Tribe. All monthly meetings of the Board of Directors shall be open to the public. Only customers with particular problems or complaints should request inclusion on the agenda of the next board meeting.

XI. AMENDMENTS OR REVISIONS

The Plan of Operation may be amended by a simple majority of Directors in attendance at a meeting called for that purpose and thereafter. approved by the RBC.

STATEMENT OF CONCERN:

In recent years, HUD, like many federal agencies has encouraged and promoted minority contracting. However, after a tribe has established itself as a bonafide contractor capable of bidding, negotiating and performing as a general contractor other obstacles arise. Although HUD advocates minority contracting, it (HUD) has difficulty dealing with the reality that there are Indian contractors and the agency must deal with them as such. The Leech Lake Reservation owns and operates a construction company with:

1.) an established performance record (see attached outline)

2.) the ability to secure bonding from a nationally established
bonding company with the aid of the SBA

3.) an on-going reservation apprenticeship program designed to
place qualified apprentices on the job and provide on site
supervisor training by journeyman level employees
