Mr. Speaker put the question whether the House would agree to so much of said report as relates to the first mentioned bill, and it was determined in the affirmative.

Ordered, That the Clerk return said bill to the Senate, with a message informing that the Assembly have non-concurred in the passage of the

same.

Mr. Speaker then put the question whether the House would agree to the remainder of said report, and it was determined in the affirmative. Ordered, That said bills be engrossed and to a third reading.

Mr. C. G. Cornell moved that the bill entitled "An act to extend the distribution of Croton water through the city of New York, and to lay the necessary mains therefor, and to deliver it at a higher elevation," be considered in the first committee of the whole not full.

Mr. Speaker put the question whether the House would agree to said motion, and it was determined in the affirmative, two-thirds of all the members present voting in favor thereof.

Mr. Opdyke, from the committee on the affairs of cities, to which was referred the bill entitled "An act to provide for stability of construction and security against conflagrations in buildings in the city of New York," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Opdyke, from the committee on the affairs of cities, to which was referred the Senate bill entitled "An act supplemental to an act entitled 'An act to provide for the coastruction of a drain or sewer in Central avenue, Johnson avenue and Knickerbocker avenue, and other streets in the city of Brooklyn,' passed May 3, 1869, and to an act amendatory thereof," reported in favor of the passage of the same, with amendments, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Opdyke, from the committee on the affairs of cities, to which was referred the Senate bill entitled "An act supplemental to an act entitled 'An act to provide for the construction of a main and lateral drain or sewer in Navy street, Johnson street and Hudson avenue, and other streets and avenues in the city of Brooklyn," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Hayes offered for the consideration of the House a resolution, in the words following:

Resolved, That Assembly bill No. 916, G. O. 1059, be considered in the next committee of the whole not full.

Mr. Speaker put the question whether the House would agree to said resolution, and it was determined in the affirmative, two-thirds of all the members present voting in favor thereof.

Mr. Lynde, from the committee on internal affairs, to which was referred the bill entitled "An act creating the office of Richmond county fire marshal, and prescribing his powers and duties," reported adversely thereto, which report was agreed to.

Mr. Lynde, from the committee on internal affairs, to which was referred the bill entitled "An act to constitute the commissioners of police of the county of Richmond a board of excise for said county,"

reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Lynde, from the committee on internal affairs, to which was referred the bill entitled "An act to give effect to a deed from the Farmers' Bank of Orwell to Benjamin Cheney," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Lynde, from the committee on internal affairs, to which was recommitted the bill entitled "An act to amend an act entitled 'An act to establish a police force in the county of Richmond,' passed April 28, 1870," reported adversely thereto, which report was agreed to.

Mr. Lynde, from the committee on internal affairs, to which was recommitted the Senate bill entitled "An act in relation to a certain highway in the county of Hamilton, appropriating certain non-resident highway moneys thereto, and repealing acts heretofore passed in relation thereto," retaining its place on third reading of bills, reported in favor of the passage of the same, with amendments, which report was agreed to, and said bill replaced on the calendar of third reading of bills.

Mr. Hendee, from the committee on State charitable institutions, to which was referred the Senate bill entitled "An act to authorize the trustees of the Willard Asylum for the Insane to appoint a fourth assistant physician," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Hendee, from the committee on State charitable institutions, to which was referred the Senate bill entitled "An act to amend section 14 of chapter 744 of the Laws of 1867, entitled 'An act to define the objects of the New York State Institution for the Blind, and to provide for its management,'" reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole. Mr. Fowler offered for the consideration of the House a resolution, in the words following:

Resolved, That Assembly bill No. 698, G. O. 775, entitled "An act to permit the Bath and Hamondsport railroad to use rails of forty pounds weight to the lineal yard in the construction of their road," be cosidered in the first committee of the whole not full.

Mr. Cocheu offered the following substitute:

Resolved, That Assembly bill No. 471, G. O. 515, entitled "An act to reorganize the fire department of the city of Brooklyn, and to reduce the number of commissioners thereof," be referred to the first committee of the whole not full.

Mr. Speaker put the question whether the House would agree to said motion of Mr. Cocheu, and it was determined in the negative.

Mr. Speaker then put the question whether the House would agree to said resolution, and it was determined in the affirmative, two-thirds of all the members present voting in favor thereof.

The House again resolved itself into a committee of the whole on the bills entitled as follows:

"An act to permit the Bath and Hammondsport Railroad Company to use rails of forty pounds weight to the lineal yard in the construction of their road."

"An act reappropriating certain moneys for the Roman Catholic Orphan Asylum of the city of New York."

"An act to extend the distribution of Croton water through the city

of New York, and to lay the necessary mains therefor, and to deliver it at higher elevations."

And after some time spent therein, Mr. Speaker resumed the chair, and Mr. Flinn, from said committee, reported in favor of the passage of said mentioned bills; which report was agreed to, and said bills ordered engrossed and to a third reading.

Mr. Goss moved to reconsider the vote by which the bill entitled "An act relating to the entry of judgments," was lost, and that that motion lay on the table.

Mr. Speaker put the question whether the House would agree to said motion to lay on the table, and it was determined in the affirmative.

The House again resolved itself into a committee of the whole on the bills entitled as follows:

"An act to amend an act entitled "An act to revise, amend and consolidate the several acts in relation to the charter of the city of Hudson,' passed May 1, 1872.”

"An act to provide for the extension of the New York, Kingston and Syracuse railroad."

"An act to reorganize the fire department of the city of Brooklyn, and to reduce the number of commissioners thereof."

And after some time spent therein, Mr. Speaker resumed the chair, and Mr. Raynor, from said committee, reported progress on said first mentioned bill, and asked leave to sit again.

The question being on granting leave,

On motion of Mr. Ray, the committee of the whole was discharged from the further consideration of said bill, and the same was ordered engrossed and to a third reading.

Mr. Raynor, from said committee, also reported in favor of the passage of said second mentioned bill; which report was agreed to, and said bill ordered engrossed and to a third reading.

Mr. Raynor, from said committee, also reported in favor of the passage of said third mentioned bill, with an amendment.

The question being on agreeing to said report,

Mr. Cocheu moved to amend the report of the committee by striking out the amendment made in committee of the whole, being the inserting after the word "act" the words "the mayor shall appoint one citizen and."

Mr. Speaker put the question whether the House would agree to said motion of Mr. Cocheu, and it was determined in the affirmative.

Mr. Speaker then put the question whether the House would agree to the report of the committee, as amended, and it was determined in the affirmative.

Ordered, That said bill be engrossed and to a third reading.

Mr. Beebe moved that the House now adjourn.

Mr. Speaker put the question whether the House would agree to said motion, and it was determined in the affirmative.

And, at 9 o'clock and 25 minutes, the House adjourned.

Mr. Fort moved to lay said order of business upon the table for the purpose of taking up reports of committees.

Mr. Speaker put the question whether the House would agree to said motion, and it was determined in the affirmative.

Mr. Prince, from the committee on the judiciary, to which was referred the bill entitled "An act to amend chapter 664, Laws of 1867, entitled 'An act to enable the supervisors of Montgomery county to refund illegal taxes,' passed April 23, 1867," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.
