CHA P. II.

AN ACT to divide the Town of Clarence, in the County of Niagara. Passed February 8, 1810.

E it enacted by the People of the State of New-York, represent

Bed in Senate and Assembly, That from and after the first Tues

day of March next, all that part of the town of Clarence, in the county of Niagara, bounded by a certain meridian line distinguished on Ellicott's map, and commonly known by the name of the west transit line, including all that part of the aforesaid town of Clarence which lies west of the aforesaid transit line, shall be and is hereby erected into a separate town. by the name of Buffaloe; and the first town meeting in the said town of Buffaloe, shall be holden at the dwelling house of Elias Ransom, in the said town of Buffaloe; and that all the remaining part of the town of Clarence shall be and remain a separate town by the name of Clarence; and that the next town meeting in the said town of Clarence, shall be held at the house of Asa Ransom, in the said town..

II. And be it further enacted, That as soon as may be after the first Tuesday of May next, the supervisors and overseers of the poor of the aforesaid towns shall by notice to be given for that purpose by the supervisors thereof, meet together and apportion the poor maintained by the said town of Clarence, and the poor nroney belonging to the same, previ-, ous to the division thereof, agreeably to the last tax list; and that each of the said towns shall for ever thereafter respectively support their own poor.

CHA P. III.

AN ACT for the Appointment of a Treasurer.

Passed February 8, 1810.

BE it enacted by the People of the State of New York, represented in Senate and Assembly, That Abraham G. Lansing, of the county of Albany, be and he is hereby appointed treasurer of this state, to continue in office until the eighth day of February, which will be in the year one thousand eight hundred and eleven.

CHA P. V.

AN ACT to vest certain Powers in the Supervisors and Assessors of the several Towns in the County of Clinton..

Passed February 17, 1810.

HEREAS it is represented to the legislature, that trespasses are and

of the gospel and schools and for the promotion of literature in the county

of Clinton, and that the inhabitants and freeholders of the respective towns have neglected to appoint commissioners agreeably to the directions of the act entitled "an act relative to lots of lands reserved for the support of the gospel and schools and for the promotion of literature, in the military tract in the county of Onondaga," passed the 23d day of March, 1798, and the act to amend the same, passed the 11th April, 1808; for remedy whereof,

I. BE it enacted by the People of the State of New-York, represented in Senate and Assembly, That from and after the passing of this act, the supervisors and assessors in their respective towns in the county of Clinton, shall have the like powers and authority vested in them and the same duties imposed on them as are vested in and imposed on the supervisors and commissioners in and by the several acts above mentioned.

II. And be it further enocted, That the supervisors and assessors in their respective towns in the said county of Clinton, shall have power to seize and take all such timber as has been or may be cut on the lots set apart as aforesaid, as well such as may be found transported from the said lots as otherwise, and that the property of such timber shall be deemed, by virtue of this act, to be vested in the said supervisors and assessors; and that the said supervisors and assessors shall have power to sell the timber so cut down or transported as aforesaid, at public vendue to the highest bidder, giving thirty days notice of the same, and apply the monies arising from such sale, in such manner as the other monies are directed to be appropriated in and by the several acts above mentioned.

111: And be it further enacted, That this act shall continue in force until commissioners are or shall be appointed in the said county according to the provisions of the several acts aforesaid, and no longer.

CHA P. VI.

AN ACT to fix the Time of holding Town Meetings in the Town of Bethel, in the County of Sullivan, and in the Town of Solon, in the County of Cortland.

Passed February 17, 1810.

I. BE it enacted by the People of the State of New York, represented

in Senate and Assembly, That the town meetings hereafter to be held in the town of Bethel and county of Sullivan, shall be held on the first Tuesday of March annually; and that the first town meeting in the said town, shall be held at the house of William Brown, in said town, on the first Tuesday of March, 1810.

II. And be it further enacted, That the town meetings hereafter to be held in the town of Solon, in the county of Cortland, shall be held on the first Tuesday of March annually.

AN ACT to appoint Commissioners to fix the Site for a Court House and Gaol in the County of Tioga, and for other Purposes.

Passed February 17, 1810.

E it enacted by the People of the State of New-York, represented in Senate and Assembly, That Nathaniel Locke, Anson Cary, and Samuel Campbell, of the county of Chenango, esquires, be and they

are hereby appointed commissioners for designating a place for a court house and gaol in the county of Tioga, as near the centre of said county as circumstances will permit; and for that purpose the said commissioners shall, as soon as may be after the first day of June next, repair to the said county, and after exploring the same, ascertain and determine by writing under their hands, to be filed of record in the clerk's office of the said county of Tioga, a fit and proper place therein for erecting the said building: Provided, That any two of the said commissioners, in case of the non-attendance of the other, shall be competent to discharge the said trust.

II. And be it further enacted, That the said commissioners shall be 2 allowed for their services at and after the rate of three dollars per day, for each and every day they shall be employed in executing the trust reposed in them by this act; which allowance shall be levied and paid as 3 part of the contingent charges of the said county of Tioga; and the treasurer thereof is hereby required and directed to pay the same out of any monies in the treasury, an account of which he shall exhibit to the board of supervisors of the said county at their next meeting thereafter. III. And be it further enacted, That the supervisors of the several 4 towns in the county of Tioga, for the time being, or a majority of them, shall be and are hereby authorized and required, to direct to be raised on the freeholders and inhabitants of the said county of Tioga, at their next annual meeting, the sum of three thousand dollars, and at their next annual meeting thereafter, the further sum of three thousand dollars, for building a court house and gaol in said county, with the additional sum of five cents on each dollar for collecting the same; which sums shall be raised and collected in the same manner as the contingent charges of the said county are raised and collected.

IV. And be it further enacted, That Joshua Ferris, Isaac Swartwout, 5 and Samuel Westbrook, of the town of Spencer, in the said county of Tioga, be and they are hereby appointed commissioners to superintend the building the court house and gaol in the said county of Tioga, at such place as shall be designated by the said commissioners so aforesaid appointed, on such plan as the said commissioners or a majority of them may conceive best; and the said commissioners or a majority of them may contract with workmen, and purchase materials for erecting said court house and gaol, and shall from time to time draw upon the treasurer of the said county for such sums of money, for the purpose aforesaid, as shall have come into the hands of the treasurer by virtue of this act; and the treasurer is hereby directed, out of the monies aforesaid, to pay to the order of the said commissioners, the several sums of money to be by them drawn for; and it is hereby made the duty of the said commissioners to account with the supervisors of the said county for the monies which they shall have received from the treasurer when thereunto required.

V. And be it further enacted, That the building to be erected for that 6 purpose, at the place which shall be designated as aforesaid, shall be the gaol of the said county of Tioga; and as soon as the said building shall, 7 in the opinion of the sheriff of the said county, be finished in such a manner as to confine his prisoners, it shall and may be lawful for such sheriff to remove his prisoners either upon civil or criminal process, to such gaol, and to confine them therein, and such removal shall not be deemed an escape.

VI. And be it further enacted, That the clerk's office of the said county 8 of Tioga, shall within three months after the first sitting of the court shall have been held in the said court house, be removed and kept at some convenient place, not exceeding two miles from the place so designated as aforesaid for a court house and gaol in said county.

VII. And be it further enacted, That the supervisors of the said coun- 9 y of Tioga, or a majority of them, are hereby authorized to purchase so
