And so it was Resolved, That a committee composed of five members be appointed, with power to send for persons and papers, to inquire whether any member or members of the twenty-eighth Congress, or any other Congress, have sold or otherwise disposed of Frémont's report, or other books printed, purchased, or distributed by order of Congress, for valuable consideration; and whether any orders have been drawn upon the Clerk for the delivery of said books; and that said committee report to this House the name of said person or persons engaged in said transactions, and all the facts thereof.

And that they examine into and report to this House what order ought to be taken, in relation to books and documents, other than Frémont's reports, now in possession of the Clerk of this House, and referred to in his communication of this day; and also to report for the consideration of the House some rule or order regulating the disposition of documents and books which may hereafter be published by order of the House.

Mr. Sawtelle, Mr. Hopkins, Mr. Sykes, Mr. Stewart, of Pennsylvania, and Mr. Wick, were appointed the said committee.

The House then again resumed the consideration of the reports and resolutions from the majority and minority of the Committee of Elections, upon the memorial of William H. Brockenbrough, praying to be admitted to a seat, in place of Edward C. Cabell, the present occupant, which was pending when the House adjourned yesterday.

The question being on agreeing to the substitute offered yesterday by Mr. Alexander D. Sims, for the said resolutions reported by the majority of the Committee of Elections.

And, after debate,

A motion was made, at fifty minutes past 2 o'clock, p. m., that the House adjourn.

And the question being put,

The following petitions, memorials, and other papers, were laid on the Clerk's table, under the 24th rule of the House, to wit:

By Mr. Levin: Ten memorials of citizens of the city and county of Philadelphia, in the State of Pennsylvania, praying an appropriation for the construction of a dry dock at the navy yard in the city of Philadelphia.

By Mr. McCrate: A petition of citizens of Thomaston, in the State of Maine, praying an appropriation for the purpose of placing buoys, spindles, &c. to mark the ship channel from Owl's Head to White Head, and between the main land and the Muscle Ledge islands, near the mouth of Penobscot bay, in the State of Maine.

Ordered, That the said memorials and petition be referred to the Committee on Commerce.

By Mr. James Thompson: A petition of John Pomroy, of Erie county, and State of Pennsylvania, praying to be released from the payment of a judgment obtained against him in the district court of the United States for the western district of Pennsylvania, as the bail of Fowler Crane, late. postmaster at Elk Creek, Erie county, Pennsylvania.

By Mr. Price: A memorial of citizens of the States of Missouri and Illinois, praying the establishment of a mail route from Jacksonville, in the State of Illinois, to Hannibal, in the State of Missouri.

Ordered, That the said petition and memorial be referred to the Committee on the Post Office and Post Roads.

By Mr. Hungerford: Three petitions of citizens of Jefferson county, and State of New York, praying for the erection of fortifications at Sackett's Harbor, on lake Ontario: which were referred to the Committee on Military Affairs.

Also, a petition of John Felt, of the town of Rutland, Jefferson county, and State of New York, praying to be released from the payment of a judgment obtained against him by the United States in the district court for the northern district of the State of New York: which was referred to the Committee of Claims.

By Mr. Maclay: A memorial of Edward Clark, of the city of Brooklyn, and State of New York, praying for the extension of letters patent for an improvement in the manufacture of white lead: which was referred to the Committee on Patents.

By Mr. Giles: A memorial of Clark Lillybridge, late physician to the emigrating Cherokee Indians, praying payment of a balance due him for services rendered: which was referred to the Committee on Indian Affairs.

By Mr. Garrett Davis: The petition of John F. Willmott, of Bourbon county, State of Kentucky, sole executor of Robert Willmott, deceased, who was an officer in the army of the Revolution-heretofore presented December 10, 1844: which was referred to the Committee on Revolutionary Claims.

By Mr. Wick: A memorial of citizens of the State of Indiana, praying a grant of land to aid the State of Indiana in the completion of the Central canal through that State: which was referred to the Committee on Public Lands.

By Mr. Maclay: A petition of James Hamilton and Philip Schuyler, of the city of New York, praying for a contract to prepare timber in the government naval yards, at a price twenty per cent. less than is now paid, or for the purchase by government of the right of using their improved machinery for "curvilinear and compound bevel sawing:" which petition was referred to the Committee on Naval Affairs.

By Mr. Delano: A petition of John Wing and others, of Knox county, and State of Ohio, praying that the balance of pension due to Dorothy Terrell, late a pensioner of the United States, and widow of a soldier of the revolutionary war, may be paid to the said John Wing: which petition was referred to the Committee on Invalid Pensions.

By Mr. Brodhead: A petition of Martha Clark, widow of Elisha Clark, a soldier of the Revolution, praying for arrears of pension due her late husband.

By Mr. Jenkins: A petition of Betsy Gould, of the State of New York, praying for a pension for services rendered by her husband in the war of the Revolution.

By Mr. Thomasson: The petition of John Rose-heretofore presented December 10, 1844.

By Mr. Cullom: A petition of Polly Owens, of the county of Fentress, State of Tennessee, and widow of Bailey Owens, a soldier in the Revolution, praying for a pension.

Ordered, That said petitions be referred to the Committee on Revolutionary Pensions.

By Mr. J. R. Ingersoll: The petition of Charles G. Ridgeley-heretofore presented January 17, 1837: which was referred to the Committee on Foreign Affairs.

By Mr. Schenck: A petition of citizens of western Ohio, praying for an

appropriation for the continuance of the Cumberland road: which was referred to the Committee on Roads and Canals.

SATURDAY, JANUARY 24, 1846.

On motion of Mr. Pollock,

Ordered, That the papers in the case of William Norris, executor of John Norris, (heretofore presented December 10, 1838,) be referred to the Committee of Claims.

The House again resumed the consideration of the reports and resolutions from the majority and minority of the Committee of Elections, upon the memorial of William H. Brockenbrough, praying to be admitted to a seat, in place of Edward C. Cabell, the sitting member.

The question being on agreeing to the following resolution, offered by Mr. Alexander D. Sims on Wednesday last, as a substitute for the said resolutions reported from the Committee of Elections, viz:

"Whereas the returns from all the election precincts in the State of Florida have not been received, and it is absolutely necessary to a just and proper decision in the case of the contested election from that State that all the returns of all the votes taken in said election shall be received before a final vote of the House is taken: therefore,

"Resolved, That the case of the contested election from the State of Florida, now before the House, be recommitted to the Committee of Elections, in order that the evidence of all the returns from all the election precincts of said State may be received and reported to the House.

"Resolved, That the contestants in said case have leave to take testimony touching the said returns and election, giving to each other respectively due notice thereof."

And, after debate,

The previous question was moved by Mr. Gordon.

Mr. Thurman moved that there be a call of the House: which motion. was agreed to.

And the roll being called through, one hundred and eighty-eight members answered to their names.

On motion of Mr. Thomas Butler King, further proceedings in the call were dispensed with.

The previous question, moved by Mr. Gordon, was then seconded, and the main question was ordered and put, viz: Will the House agree to the first of the said resolutions reported by the Committee of Elections, (the substitute offered by Mr. Sims, inasmuch as it proposed to recommit the report and resolutions, being set aside by the previous question.)
