1. Be it enacted, &c. That all snags, sawyers, stumps, logs, Snags, &c. to and obstructions of every description, which tend to endanger the steam boat navigation of the Ohio river, at any navigable stages of the water, and which present themselves, and are to be found on the banks and sides of the river, shall be removed, so that the navigation of said river may be rendered at all times safe; and the same shall be done under the supervision and direction of the secretary of war, and through the aid of some practical agent acquainted with the situation of the river, its respective bars, islands, and dangerous places and parts; and he shall Jikewise cause the channel of said river, at a part usually called the Grand Chain, near its mouth, so to be deepened by a proper channel formed, that, at the usual state of the water, steam boats may be enabled safely to pass and repass the same.

CHAP. 251. An act for the gradual improvement of the navy of the United States.

1. Be it enacted, &c. That, for the gradual improvement of the navy of the United States, the sum of five hundred thousand dollars per annum, for six years, is hereby appropriated, to be applied as in this act prescribed, and as may, hereafter, be directed by law.

2. 3. That the president of the United States be, and he is hereby, authorized to take the proper measures to preserve the ve oak timber growing on the lands of the United States, and he is also authorized to reserve from sale such lands, belonging to the United States, as may be found to contain live oak, or other timber, in sufficient quantity to render the same valuable for naval purposes.

4. That the president of the United States be, and he is hereby, authorized to cause to be constructed two dry docks, on the most approved plan, for the use of the navy of the United States, the one of said docks to be erected at some point to the south, and the other to the north of the Potomac river.

CHAP. 254. An act concerning the location of land reserved for the use of a seminary of learning in the state of Louisiana.

1. Be it enacted, &c. That the secretary of the treasury be, and he is hereby, authorized to locate a quantity of land, not exceeding two entire townships, reserved by the eleventh section of the act of the twenty-first April, eighteen hundred and six, and by the seventh section of the act of the third of March eighteen hundred and eleven, for the use of a seminary of learning in the state of Louisiana, on any of the public lands in said state, in sections corresponding with any of the legal divisions into which the public lands are authorized to be surveyed.

APPENDIX.

IN CONGRESS JULY 13, 1787.

An ordinance for the government of the territory of the United States northwest of the river Ohio.

Be it ordained by the United States in congress assembled,

That the said territory, for the purposes of temporary government, be one district; subject, however, to be divided into two districts, as future circumstancès may, in the opinion of congress, make it expedient.

Be it ordained by the authority aforesaid, That the estates Rules of inheritance, &c. both of resident and non resident proprietors in the said territory, dying intestate, shall descend to, and be distributed among their children, and the descendants of a deceased child, in equal parts; the descendants of a deceased child or grand child to take the share of their deceased parent, in equal parts among them and where there shall be no children or descendants, then in equal parts to the next of kin, in equal degree; and among collaterals, the children of a deceased brother or sister of the intestate shall have, in equal parts among them, their deceased parents' share; and there shall, in no case, be a distinction between kindred of the whole and half blood; saving in all cases to the widow of the intestate, her third part of the real estate for life, and one third part of the personal estate; and this law relative to descents and dower, shall remain in full force until altered by the legislature of the district. And until the governor and judges shall adopt laws as herein after mentioned, estates in the said territory may be devised or bequeathed by wills in writing, signed and sealed by him or her, in whom the estate may be, (being of full age,) and attested by three witnesses; and real estates may be conveyed by lease and release, or bargain and sale, signed, sealed, and delivered, by the person, being of full age, in whom the estate may be, and attested by two witnesses, provided such will be duly proved, and such conveyances be acknowledged, or the execution thereof duly proved, and be recorded within one year after proper magistrates, courts, and registers, shall be appointed for that purpose; and personal property may be transferred by delivery; saving, however, to the French and Canadian inhabitants, and other settlers of the Kaskaskies, Saint Vincents, and the neighboring villages, who have heretofore professed themselves citizens of Virginia, their laws and cus
