A

Ab initio.-From the beginning. Abstract. (See Brief.)

Act of God. An irresistible superhuman cause, such as no reasonable human foresight, prudence, diligence and care can anticipate and/or prevent.

Act to Regulate Commerce-An act of Congress regulating the practices, rates and rules of transportation lines engaged in handling interstate traffic (now known as the Interstate Commerce Act).

Ad Valorem. According to value.

Advanced Charge. The amount of freight or other charge on a shipment advanced by one transportation line to another, or to the shipper, to be collected from the consignee.

Affidavit.-A written statement sworn to before a Notary Public.

Affreightment. The act of hiring or contracting, by which a vessel or space is engaged for the transportation of freight.

Agency.—(a) The relations existing between two parties by which one is authorized to transact certain business for the other. (b) Office or business of an agent. Agency Tariff.-A tariff issued by a publishing agent for one or more transportation lines.

Agent: A person authorized to transact business for and in the name of another.

Agreed Valuation.--The value of shipment agreed upon in order to secure a specific rating and/or liability. Agreed Weight.-The weight prescribed by agreement between carrier and shipper for goods shipped in certain packages or in a certain manner.

Aliunde. From another source.

All Rail.-Entirely by rail transportation.
All Water.-Entirely by water transportation.
Alongside. By the side of.

Anderson Class Scale.-Rate scale applied intra New England.

Ante.-Before. Anti. Against.

Any-quantity Rate.-A rate applicable to an article in any quantity.

Arbitrary. (a) A fixed amount which a transportation line agrees to accept in dividing joint rates. (b) A fixed amount added to or deducted from a rate from one station to make a rate from another station. (c) A fixed amount added to or deducted from a rate to one station to make a rate to another station. Arrival Notice.-A notice furnished to consignee of the arrival of freight.

Ash Pan Act.-An act of Congress requiring that locomotives shall be equipped with ash pans conforming to certain standards.

Assigned Siding.-A sidetrack owned by a transportation line and assigned for the use of one or more firms or individuals in loading or unloading cars.

Assignee. One to whom a right or property is transferred. Assignor.—One by whom a right or property is transferred.

Astray Freight.-Freight bearing marks indicating owner and destination, but separated from the waybill. (See Excess and Over Freight.)

Astray Freight Way-bill.-A way-bill used for astray freight. (See Free-astray.)

Automobile Car.-A car equipped with facilities for safe and proper handling of automobiles. Average Demurrage Agreement.-An agreement made between a shipper and a transportation line whereby the shipper is debited for the time cars are held for loading or unloading beyond a certain period and credited for the time cars are released by him within a certain period, demurrage charges being assessed by the transportation line, usually at the end of the month, for any outstanding debits.

Barge. A flat-bottomed boat. Barratry.-The action of officers or crews of a ship in wilfully destroying or injuring a ship or its cargo. Basing Point.-A point the rates to and from which are used in constructing through rates between other points.

Basing Rate.-A rate used only for the purpose of constructing other rates. (See Proportional Rate.)

Belt Line. A short railroad operating within and/or around a city.

Billed Weight.-The weight shown in way-bill and freight bill.

Billing and Instruction Book.—(See Guide Book).
Bill of Lading:-

Straight Bill of Lading.-A non-negotiable document by which a transportation line acknowledges receipt of freight and contracts for its movement. The surrender of the original Straight Bill of Lading is not required by transportation lines upon delivery of the freight, except when necessary for the purpose of identifying the consignee. (See Form 1.) Order Bill of Lading.-A negotiable document by which a transportation line acknowledges receipt of freight and contracts for its movement. The surrender of the original Order Bill of Lading, properly endorsed is required by transportation lines upon delivery of the freight, in accordance with the terms of the Bill of Lading. (See Form 2.) Bills of Lading Act.-An Act of Congress relating to the preparation and negotiability of bills of lading. Blanket Bond.-A bond covering a group of persons, articles or properties.
